The Board of Supervisor met in Session on the above date with the following members present: O’Farrell, Peterson, Condon, Kirkberg and Chairperson Magnusson.
Moved by O’Farrell, seconded by Peterson to approve minutes of January 29, 2002 meeting. Motion carried unanimously.
Moved by Peterson, seconded by Condon to receive and place on file Drainage Repairs in Joint Drainage District #3 Webster & # 9 Humboldt. Motion carried unanimously.
Moved by Condon, seconded by Kirkberg to receive and place on file resignation of Matt Girdley, Jailer, effective January 25, 2002. Motion carried unanimously.
Moved by Kirkberg, seconded by O’Farrell to approve and authorize Chair to sign Water Well Grant for Fiscal Year 2002-2003 in the amount of $16,500. (Copy on file in Auditor’s Office). Motion carried unanimously.
Moved by O’Farrell, seconded by Peterson to approve and authorize Chair to sign letter naming Tony Jorgenson as Grant Administrator for Bureau of Justice Bulletproof Vest Partnership Grant. Motion carried unanimously.
Moved by Peterson, seconded by Condon to adopt the following Resolution:
RESOLUTION
WHEREAS, the Iowa Chamber Alliance is promoting a proposal to change the Road Use Tax Fund Distribution Formula to increase the city’s share from 20 to 25 percent, to increase the state’s share from 47.5 to 50 percent, and to decrease the county’s share from 32.5 to 25 percent, and to change the basis for the division of the county’s share from area and needs to population,
AND WHERAS, we foresee that if this proposal is successful, it will result in dramatic changes to funding levels for County Secondary Road Departments, affecting the ability to provide maintenance and construction services on Secondary Roads,
AND WHEREAS, the County Secondary Road System is vitally important with respect to providing a transportation system that serves the needs of the agricultural industry, and provides safe travel routes for school buses, mail carriers, rural residents, and the traveling public,
AND WHEREAS, the continued upkeep of the rural roads is so very important that funding levels cannot be shifted away from them.
BE IT THEREFORE RESOLVED that the Webster County Board of Supervisors oppose the Iowa Chamber Alliance proposal in the initial form that it has been presented.

Moved by Condon, seconded by Kirkberg to receive and place on file appointment of Loree Stewart as Clay Township Trustee for the residue of the term expiring December 31, 2002. Motion carried unanimously.
Moved by Kirkberg, seconded by O’Farrell to approve the following to clarify the terms for Webster County Supervisor Districts as a result of the latest federal decennial census, per County Attorney’s recommendation:

Supervisor District # 2 Not affected by redistricting (Term expires December 31, 2004)
Supervisor District # 3 2 year term
Supervisor District # 4 4 year term
Supervisor District # 5 2 year term

Moved by O’Farrell, seconded by Peterson to approve assignment of Tax Sale Certificates #93039 and #94011 in the name of J.D. Moore to the City of Clare, Iowa (Real Estate Parcel # 00400/0000103000 and # 00400/0000111000), per recommendation of County Treasurer. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Utility Permit Application for Frontier Communications to install cable in Section 12, Douglas Township. (Copy on file in Engineer’s Office). Motion carried unanimously.
Shirley Weimers discussed her concerns in reference to Drainage District #247 and the amount she was required to pay for the removal of an obstruction in the open ditch. The District is joint with Humboldt County and therefore a drainage meeting will be set in the near future to discuss this matter with the Joint Board.
At l0:30a.m. a Public Hearing was held on Final consideration of request to rezone approximately 111 acres from Agricultural (A-l) to Agricultural (A-2), submitted by E.P. Frazier who intends to sell the following described property as acreages: The North One-half of the Southwest Quarter and the East One-half of the Southeast of the Southwest Quarter and Lots 8 and 12 of County Auditor’s Sub-division of the Southwest Quarter of Section 10, Township 88 North, Range 28, West of the 5th P.M., Webster County, Iowa, except for tracts. No objections or comments were heard. Moved by Condon, seconded by Kirkberg to approve final consideration and to approve said amendment to Zoning Ordinance 024 and adopt the following resolution to amend the Webster County Comprehensive Plan and Future Land Use Map.
WHEREAS, E.P. Frazier Inc. has petitioned the Board of Supervisors to change the Zoning District from Agricultural A-1 to Agricultural A-2. The purpose is to sell property as acreages. The legal description is: The North One-half of the Southwest Quarter and the East One-half of the Southeast Quarter of the Southwest Quarter, all in Section 10, Township 88 North, Range 28 West of the 5th P.M. Webster County, Iowa; and Lots 8 and 12 of County Auditor’s Sub-division of the Southwest Quarter of Section 10, Township 88 North, Range 28, West of the 5th P.M., Webster County, Iowa. EXCEPT Land Condemned by Webster County as shown in Deed Record Book 143 page 349. AND EXCEPT A tract of land located in the Southwest Quarter of Section 10, Township 88 North, Range 28, West of the 5th P.M., Webster County, Iowa, described as: Beginning at a point in the centerline of the Public Highway as running Northerly and Southerly through said Southwest Quarter, said point being 1,220.0 feet, more or less, North of the North line of Lot 9 of the County Auditor’s Subdivision of the Southwest Quarter of said Section 10, running thence East 265.0 feet, thence running South 400.0 feet, thence West parallel with first course, to the center line of said Public Highway, thence Northerly along said center line of said Highway to the point of beginning., and
WHEREAS, the Comprehensive Plan and Future Land Use Map must be functional and flexible to fulfill its purpose as a framework for public officials to make decisions that implement common goals; and
WHEREAS, the Planning and Zoning Commission has held a public hearing regarding the pros and cons of the proposed change as they related to the established policy, goals, and objectives of the Comprehensive Plan; and
WHEREAS, the Planning and Zoning Commission has submitted a report to the Board of Supervisors stating their recommendation; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS THAT, the Future Land Use Map is amended to show that the property described above is to change in classification from Agricultural A-1 to Agricultural A-2.

At l1:00a.m. Public Letting was held to receive bids for Three Single Axle Dump Trucks complete with Box, Plow, Sander and Hydraulics. Upon opening of bids it was moved by O’Farrell, seconded by Peterson to table bids until to February 12, 2002, to allow Engineer to review bids. Motion carried unanimously.

Moved by Condon, seconded by Kirkberg to approve and authorize Chair to sign Contract Agreement with Valic for Deferred Compensation Plan. (Copy on file in Auditor’s Office). Motion carried unanimously.
Moved by Kirkberg, seconded by O’Farrell to approve Family Medical Leave of Absence for Sara Price. Motion carried unanimously.
Moved by O’Farrell, seconded by Peterson to approve employment of Michael Alan Halligan as fulltime Deputy Sheriff, at an annual salary of $39,718.70, effective February 11, 2002. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Fiscal Year 2002-2003 Funding Agreement for Sharing of Mental Health Advocate Expenses. (Copy on file in Auditor’s Office). Motion carried unanimously.

Moved by O’Farrell, seconded by Peterson to approve minutes of February 12, 2002 meeting. Motion carried unanimously.
A Public Hearing on Proposed Budget Amendment was held. No objections or comments were heard. Moved by Peterson, seconded by Condon to adopt the following Budget Amendment to Fiscal Year 2001-2002 budget and authorize department appropriation increases: Increase Public Safety $86,000 changing the Sheriff’s Department (#005 appropriation to 2,205,808; Increase Interprogram Services $140,000 changing Law Enforcement Center Department #008 appropriation to $346,724 and Social Services Building Department #055 to $118,630. Motion carried unanimously.
Moved by Condon, seconded by Kirkberg to approve transfer from Revenue Sharing Fund in the amount of $107,211.28 and from Capital Projects in the amount of $36,682.07 to General Basic, for capital project improvements.

Moved by Kirkberg, seconded by O’Farrell to adopt the following Resolution:
WHEREAS, Webster County has adopted Webster County Zoning Ordinance #24 in accordance with Chapter 355, Iowa Code.
WHEREAS, Webster County Zoning Ordinance #24 provides that the county Board of Supervisors may prescribe and charge fees for compliance permits.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS THAT, the following fees shall be applicable for the issuance of permits and other services by the Zoning Administrator effective upon approval of this resolution.
Main Structure – Includes new houses, replacing houses, moving a manufactured house onto site, moving a modular house onto a site, etc. Square footage is the footprint of the building.

At 10:30a.m., a Public Hearing was held on first consideration of a request from Brian and Molly Illg to rezone the following described property from A-1 to A-2: A parcel of land located in the Northeast Quarter of the Northeast Quarter and in the Southeast Quarter of the Northeast Quarter of Section 12, Township 90 North, Range 30 West of the 5th P.M. Webster County, Iowa. Having heard oral comments, it was moved by O’Farrell, seconded by Peterson to approve first consideration of said request for rezone, to waive second consideration and to set March 15, 2002, at 10:30a.m. as the time and date for final consideration. Roll call vote: Ayes – O’Farrell, Condon, Kirkberg and Magnusson. Nay – Peterson. Motion carried.
