The Board of Supervisor met in Session on the above date with the following members present: Magnusson, Peterson, Condon, Gill and Nolting.
Moved by Gill, seconded by Nolting to approve minutes of April 27, 2004 meeting. Motion carried unanimously.
Moved by Nolting, seconded by Peterson to receive and place on file the following Drainage Repairs: D.D.#5, D.D.#218, D.D.#140, D.D.#69, D.D.#219 and D.D.#52. Motion carried unanimously.
Moved by Peterson, seconded by Magnusson to approve bond of William F. Kahl, d/b/a Kahl Construction for sewer/septic tank installation. Motion carried unanimously.
Moved by Magnusson, seconded by Gill to approve temporary full time employment of spray crew effective May 6, 2004 as follows: Myron Groat and John Spillman at the rate of $7.25 per hour; and Jill Zabel and Thomas Wood at the rate of $8.50 per hour. Motion carried unanimously.
Moved by Gill, seconded by Nolting to approve and authorize Chair to sign lease agreement with Xerox for copier in Recorder’s office. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Nolting, seconded by Peterson to approve letter of support for Fort Dodge’s Community Health Center. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Peterson, seconded by Magnusson to adopt Resolution Approving Webster County’s participating in a Rise Immediate Opportunity Funding Program.
RESOLUTION APPROVING WEBSTER COUNTY’S
PARTICIPATION IN A RISE IMMEDIATE
OPPORTUNITY FUNDING PROGRAM
WHEREAS, the Code of Iowa authorizes the RISE Program as a mechanism to assist the location of industries within Iowa by providing incentives to local governments to assist in funding road improvements when such is required as part of the industrial location criteria; and
WHEREAS, the Iowa Department of Transportation has established program guidelines and has provided an open window of opportunity for submitting applications for the RISE Program; and
WHEREAS, Webster County is actively pursuing industrial businesses to establish operations in the area of Hayes Avenue west of Fort Dodge, Iowa; and
WHEREAS, a developer has indicated a desire to construct a new industrial plant on an approximate 320 acre site near the former community of Tara, which will create new job opportunities for the Webster County; and
WHEREAS, a key ingredient in the selection of the site is access to major highways, and more specifically, the construction of a paved access to the proposed plant location, with such action representing an immediate non-speculative opportunity for Webster County; and
WHEREAS, the roadway will remain dedicated to public use and under the jurisdiction of Webster County, who will be responsible for its maintenance.
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that:
The Webster County Board of Supervisors fully endorses the improvement of Hayes Avenue, and authorizes the Chair to sign all necessary application documents and to submit the same to the Iowa Department of Transportation; and that
The Webster County Board of Supervisors will solicit the services of the MIDAS Council of Governments and the Webster County Development to assist in application preparation; and that
The Webster County Board of Supervisors will assure the required local match is provided to the RISE funds through the use of Webster County Road Funds, if approved by the Iowa Department of Transportation.

Moved by Magnusson, seconded by Gill to table for two weeks (until May 18, 2004) consideration of assignment of Tax Sale Certificate and compromise of taxes on the following described property: Lots 15 and 16 in County Auditor’s Taxation Plat of Lots One through Eight of Cheney’s subdivision of Government Lots Five and Six and the thirty-three foot road lying adjacent to the North end of said Lots 15 and 16, all in Section 32, Township 89 North, Range 28 West of the Fifth P.M., Webster County, Iowa. Motion carried unanimously.

Moved by Nolting, seconded by Peterson to receive and place on file the following Drainage Repairs: D.D.#5 Lateral 8 and D.D.#219. Motion carried unanimously.
Moved by Peterson, seconded by Magnusson to receive and place on file annual update for Manure management Plan of Gordon Farms, Inc. in Sections 18 and 23 Freedom Township (Hamilton County). Motion carried unanimously.
Moved by Magnusson, seconded by Gill to approve employment of Andrew Hockenson, Park Ranger, salary of $27,190.00, effective May 13, 2004, per recommendation of Matt Cosgrove, Webster County Conservation Director. Motion carried unanimously.
Moved by Gill, seconded by Nolting to approve temporary full time employment of the following as Park Ranger Interns at the rate of $7.25 per hour, effective May 17, 2004, per recommendation of Matt Cosgrove, Webster County Conservation Director: Robert Allen, Tyler Stubbs and Kyle Kutz. Motion carried unanimously.
At 10:30a.m. a Public Bid Letting for Concrete Pavement Patching was held. Moved by Gill, seconded by Nolting to accept low bid submitted by TEK Builders, Inc. in the amount of $52,513.86 and authorize Chair to sign contract documents upon review of Engineer Randy Will. Motion carried unanimously.
Dan Reese addressed his concern of a mosquito problem in large ponds east of the limestone mines. Board will look into this matter.

The Board of Supervisor met in Session on the above date with the following members present: Magnusson, Peterson, Condon, Gill and Nolting.
This being the time and date set for public auction of the Tax Sale Certificates PB#90005, PB#90004, PB#90006, PB#90056, and PB#90058, Chairman Condon read aloud the following disclaimer: “Today, Webster County is only offering the tax sale certificate it holds on the following parcels. Webster County makes no warranties as to the value, condition, hazards or other liabilities of the parcels. Bidders at this sale should contact their own attorney if they have any questions. The highest bidder must pay the total amount of the bid and the $15.00 registration fee immediately after their bid is accepted. The highest bid will be accepted in full satisfaction of the delinquent taxes on the parcel.”
Following the auction of each tax sale certificate it was moved by Gill, seconded by Nolting to accept the following bids and compromises of taxes for the following tax sale certificates and place on agenda for Tuesday May 18, 2004 the finalization of said assignment of tax sale certificates:

Moved by Gill, seconded by Nolting to approve the following bonds for septic tank installation and/or well drilling: Dayton Farm Drainage, Inc., Mort’s Well Company, and Mike Pearson. Motion carried unanimously.
Moved by Nolting, seconded by Peterson to approve and authorize Chair to sign utility permit application from Frontier Communications to bury approximately 230 feet of telecommunications cable along the east side of Old Highway 169 in Section 3, T88N, R29W, Elkhorn Township. Moved by Peterson, seconded by Magnusson to approve the following Department appropriation changes: Correct Dept 054 decrease from $5000.00 to $1800.00 and Department 051 increase from $27,425 to $24,225; and decrease Department 005 (Sheriff) $4,500.00 and increase Department 028 (Medical Examiner) $4,500.00. Motion carried unanimously.

Moved by Gill, seconded by Nolting to approve and authorize Chair to sign resolution to temporarily close 160th Street between Nelson and Oates Avenues for tile and culvert replacements. (Copy on file in Auditor’s office). Motion carried unanimously.
Approve and authorize Chair to sign resolution to temporarily close Route D26 between George Avenue and Route D20 for culvert replacement.
RESOLUTION
WHEREAS, the Webster County Board of Supervisors is empowered under authority of Sections 321.236, 321.255 and 321.345 of the Code of Iowa to regulate highways under their jurisdiction, as deemed necessary, and
WHEREAS, Project L-890710—73-94 involves a culvert replacement on Route D26 (230th Street) approximately 0.5 miles west of Route D20, which requires a portion of Route D26 (230th Street) to be temporarily closed from the junction of Route D20 west to the junction of George Avenue and a detour to be designated, and
WHEREAS, the Webster County Engineer has received permission to temporarily designate a portion of U.S. Highway 20 as a detour route, and
WHEREAS, the Webster County Engineer is authorized on behalf of the Board of Supervisors to execute the above requirements until such time as a formal resolution can be executed by the Board of Supervisors,
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that the following roads be designated as a detour route:
From the junction of Route D26 (230th Street) and Route D20, thence Southwesterly approximately one mile on Route D20 to the junction of U.S. Highway 20; thence continuing Southwesterly approximately one-half mile on U.S. Highway 20 to the junction of George Avenue; thence North approximately 0.7 miles on George Avenue to the junction of Route D26 (230th Street);
BE IT FURTHER RESOLVED that the traffic control devices for the aforementioned road closure and detour route were established at 6:30 a.m. Monday, May 24, 2004 and shall continue for the duration of said construction project.
