Moved by Gill, seconded by Lizer to approve full-time employment of Tracy Hawley, Motor Vehicle Department, effective July 1, 2005, per recommendation of Janice Horton, Webster County Treasurer. Ayes: Nolting, Lizer and Condon. Nays: Gill. Motion carried.
Moved by Lizer, seconded by Condon to approve 5-day Class B Beer Permit for Shellabration, Inc. Motion carried unanimously.

Moved by Condon, seconded by Nolting to approve and authorize Chair to sign utility permit application from the City of Fort Dodge to install 12-inch water main along the south side of 170th Street (Route D14) from Nelson Avenue (Route P56) east 6550 feet to Omaha Cold Storage. Moved by Nolting, seconded by Gill to approve and authorize Chair to sign permit to work in the road right-of-way from Kenny Johnson to harvest grass in the east road ditch along Route C56 north of Vincent. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Gill, seconded by Lizer to approve employment of John Winninger, Class C Equipment Operator, at the rate of $13.62 per hour, effective June 20, 2005. Motion carried unanimously.
Moved by Lizer, seconded by Condon to approve and authorize Chair to sign detour agreement with the Iowa DOT to use the Hamilton/Webster County Line (Yankee Avenue) between Route D20 and Highway 20 as a detour route due to railroad crossing repairs on Iowa Highway 17 at Highview from June 20th to June 30th, 2005. (Copy on file in Engineer’s office). Motion carried unanimously.
At 10:30a.m. a Public Hearing was held to consider apportionment of taxes assessed against the following properties: Lots 15 and 16 of West River Addition and part of the Northeast Quarter of Section 31, Township 89 North, Range 28 West, Webster County, Iowa. Attorney Mark Lowe reviewed the apportionment of taxes against said property. No objections were heard, but due to a death in the family of Ernest Kersten, Attorney for the plaintiff in this case, Attorney Lowe will discuss the outcome of this hearing with Attorney Kersten and if need be return his findings to the Board. Moved by Gill, seconded by Lizer to close the Public Hearing. Roll Call: Ayes: all. Nays: none. Motion carried unanimously.

Moved by Condon, seconded by Nolting to approve transfer from General Basic Fund to Secondary Road Fund in the amount of $70,080.18 and transfer from Rural Basic Fund to Secondary Road Fund in the amount of $428,131.08, per Fiscal Year 2004-2005 Budget. Motion carried unanimously.
Moved by Nolting, seconded by Gill to approve cancellation of taxes on mobile home – Junk Certificate #940105428 in the amount of $163.00, taxes, interest and cost. Motion carried unanimously.

(Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Gill, seconded by Lizer to approve low bid submitted by W & H Cooperative in the amount of $l.10 per gallon furnish liquid propane to Secondary Road and Conservation Departments for FY2006, from the following bids received and opened: (TYPE OUT). Motion carried unanimously.

The Board of Supervisor met in Session on the above date with the following members present: Magnusson, Condon, Gill, and Lizer. Absent: Nolting.
Moved by Gill, seconded by Lizer to adopt the following Resolution:
RESOLUTION
RESOLUTION to initiate vacation of the road located in the West Half (W1/2) of the Southwest Quarter (SW1/4) of Section 34, Township 89 North, Range 28 West, and also along the line between Sections 5 and 6 in Township 88 North, Range 28 West of the Fifth Principal Meridian, Webster County, Iowa, terminating at the North Bank of the Des Moines River.
WHEREAS a resolution to close, but not vacate, said road was passed by the Webster County Board of Supervisors on the 29th Day of October, 1968, and
WHEREAS said road has not been used or maintained since above mentioned date, and
WHEREAS United States Gypsum Company, as an abutting land owner, has requested vacation of said road, and
WHEREAS said road and adjacent property are planned for inclusion in a large scale off-highway vehicle park, and
WHEREAS said road is not needed as an access for the off-highway vehicle park,
NOW THEREFORE BE IT RESOLVED, that the Webster County Board of Supervisors hereby proposes the vacation of the following described parcel of road right of way, to wit:
A road 66.0 feet wide extending 33.0 feet on each side of the centerline described as follows: Commencing at a point 8.0 feet North and 571.0 feet due East of the West One-Quarter (W1/4) Corner of Section 34, Township 89 North, Range 28 West of the Fifth Principal Meridian, Webster County, Iowa; thence South 1o 12’ East 867.0 feet; thence South 6o 53’ East 730.9 feet; thence South 2o 11’ East 1298.7 feet to intersect that part of the road known as “The Maher Road “ running on and along the line between Sections 5 and 6, Township 88 North, Range 28 West of the Fifth Principal Meridian, Webster County, Iowa; thence South along the Maher Road on the line between said Sections 5 and 6, terminating on the North Bank of the Des Moines River.
BE IT FURTHER RESOLVED, that a public hearing on the proposed vacation of above described road be set for 10:30 A.M. on the 2nd day of August, 2005 in the Supervisors Room of the Webster County Courthouse in Fort Dodge, Iowa, and that the County Engineer send notice to adjacent landowners explaining proposed vacation and requesting their comments or claims.
