The Board of Supervisor met in Session on the above date with the following members present: Magnusson, Condon, Gill, Lizer and Nolting.
Auditor call meeting to order
Moved by Nolting, seconded by Gill to appoint Floyd Magnusson as temporary Chairperson. Chairman Magnusson called for a roll call vote. Ayes – Magnusson, Nolting, Lizer and Condon. Nays – Gill. Motion carried.
Moved by Magnusson, seconded by Condon to appoint Greg Nolting Chairperson for Year 2006. Motion carried unanimously.
Moved by Nolting, seconded by Condon to appoint Joel Lizer Vice-Chairperson for Year 2006. Motion carried unanimously.
Moved by Gill, seconded by Lizer to approve minutes of December 27, 2005 meeting. Motion carried unanimously.
Moved by Lizer, seconded by Condon to authorize Auditor to issue warrants for Year 2006 when Board is not in session for the following named purposes: freight, express, postage, utilities, salaries and payroll where such compensation shall have been previously fixed by the Board upon Certificate of the officer or foreman under whom such compensation shall have been earned. Motion carried unanimously.
Moved by Condon, seconded by Magnusson to approve the following Board appointments: Reappoint Ronald Campbell and Emmett Martin to three-year term on Veteran Affairs Commission; appoint Dr. James Wolff to three-year term on Board of Health; reappoint Joe Condon and LeRoy Schwendemann to 5-year term on Board of Adjustment; appoint Jim Kersten to fill vacancy on Conservation Board and appoint James Eslick to 5-year term on Conservation Board. Motion carried unanimously.

Moved by Condon, seconded by Magnusson to adopt the following resolution:
RESOLUTION
CONSTRUCTION EVALUATION RESOLUTION
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2006 and January 31, 2007 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF Webster COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

At 10:30a.m. a Public Hearing was held to consider a proposal to dispose of the following described real property, for a public purpose to the Iowa Department of Correctional Services, pursuant to the provisions of Section 331.361 of the Code of Iowa: The East twenty-four feet (24’) of Lot 3, Block 20, Original Town of Fort Dodge, Iowa. No objections being heard, Chairman Nolting closed public hearing.
Moved by Lizer, seconded by Condon to approve disposing of the East twenty-four feet (24’) of Lot 3, Block 20, Original Town of Fort Dodge, Iowa, to Iowa Department of Correctional Service and further to authorize the Chair to sign Quit Claim Deed for the same as prepared by County Attorney. Roll call vote: Ayes-Magnusson, Gill, Lizer, Condon and Nolting. Nays-none. Motion carried unanimously.

Moved by Magnusson, seconded by Lizer to approve employment of Dale Iles, Welder/Fabricator at Otho Shed, at the rate of $14.12 per hour, effective January 16. 2006. Motion carried unanimously.
Moved by Lizer, seconded by Condon to approve and authorize Chair to sign Class C Beer Permit renewal for BB’s Country Store. Motion carried unanimously.

Moved by Lizer, seconded by Gill to approve minutes of January 10, 2006 meeting. Motion carried unanimously.
Moved by Gill, seconded by Condon to approve the following appointments, effective January 23, 2006, per request of Sheriff Mickelson: Chris O’Brien to the position of Sergeant and assigned to patrol with an annual salary of $53,043.28; and Jim O’’Brien to the position of Chief Deputy with an annual salary of $54,512.95. Motion carried unanimously.
Moved by Condon, seconded by Magnusson to approve pay adjustment of Gary Simonsen, Civil Process Server, effective January 17, 2006, per recommendation of Sheriff Mickelson. Motion carried unanimously.
Moved by Magnusson, seconded by Lizer to receive and place on file Sheriff’s Report of Fees Collected for period ending December 31, 2005. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Lizer, seconded by Gill to receive and place on file the Webster County Compensation Board to FY07 Elected Official’s salary recommendations as follows: Supervisors - $34,000; Chairperson - $34,650; Sheriff - $69,000; Auditor, Recorder and Treasurer - $52,500; and County Attorney $82.500. Motion carried unanimously.
Moved by Gill, seconded by Condon to receive and place on file Manure Management Annual Update for Webster Pork, Inc. in Section 22 Clay Township. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Magnusson to approve abatement of the following mobile home taxes, per recommendation of County Treasurer: Gregory Peet in the amount of $220.00 and Diane Reed in the amount of $33.00. Motion carried unanimously.
Moved by Magnusson, seconded by Lizer to approve and authorize Chair to sign Iowa DOT Right of Way Agreement No. 2006-1-077 for county road relocations and/or reconstruction on relocated U.S. Highway 20 from the Webster County line east to Moorland. Jeanette Miller, representing Children and Families of Iowa discussed FY07 funding request. No action taken.
Floyd Magnusson and James Gill announced that they would not be seeking re-election this year.

At 8:30a.m. the Board of Supervisors, acting as the canvass board, to Canvass vote of Drainage District No. 96 Trustee Election held on January 21, 2006. Moved by Lizer, seconded by Condon to approve the following as the official canvass of Drainage District #96, Trustee District #1 election held on January 21, 2006: Dale Gerken 6 votes and duly elected to a three year term. Motion carried unanimously.

Moved by Lizer, seconded by Condon to approve and authorize Chair to sign utility permit application from Frontier Communications to bury approximately 5550 feet of copper cable along the east and north sides of Mill Road in Section 34, Cooper Township. (Copy on file in Engineer’s office). Motion carried unanimously.
At 10:30a.m., a Public Hearing was held to authorize the sale of the following described real estate: Lot one, except the north seven feet, and Lot Two, Block One, and the north one half of the east one half of the vacated Second Street adjoining, all in Original Town of Lanyon, Webster County, Iowa. No objections being heard, it was moved by Condon, seconded by Magnusson to adopt the following resolution:
SALE OF REAL PROPERTY
WHEREAS, the Webster County Board of Supervisors has determined that said real property should be sold by the Webster County Auditor at public auction; and
WHEREAS, the Board of Supervisors having given proper notice to the public and having complied with the procedures set forth in Iowa Code Section 331.361.
BE IT RESOLVED that the Webster County Board of Supervisors hereby authorizes the sale by the Webster County Auditor of the following described real property at public auction to be held on February 13, 2006 at 10:00 a.m. on the described site in Lanyon, Iowa and under such circumstances and reasonable terms as the auditor shall determine for the appropriate disposition of the property.
Lot No. One (1), except the North Seven (7) feet of said Lot One (1), and Lot No. Two (2), Block One (1) and the North One Half (1/2) of the Vacated Second Street adjoining, all in the Original Town of Lanyon, Webster County, Iowa, District #00470, Parcel # 1835127005.
BE IT FURTHER RESOLVED that upon the completion of the sale of the real property by public auction the Auditor shall provide to the Webster County Board of Supervisors the highest bid and the appropriate documentation for the Board’s final consideration and approval.
