PROCLAMATION
WHEREAS, 74 PERCENT OF Americans say that addiction to alcohol has had some impact on them at some point in their lives, whether it was their own personal addiction, that of a friend or family member, or any other experience with addiction; and
WHEREAS, a 63-percent majority of Americans also say that addiction to either drugs or alcohol has had a great deal or some impact on their lives; and
WHEREAS. Stigma and discrimination present obstacles and can be a mark of disgrace to those with substance use disorders who need access to treatment facilities, and for those who want to reestablish their place in the community by entering the workforce; and
WHEREAS, educating our community about how substance use disorders affect children, families, and all community members is essential to overcoming stigma and discrimination; and
WHEREAS, we must recognize the achievement of those who seek out treatment services and ensure that such services are readily available to those who need assistance; and
WHEREAS, substance use disorders are a treatable, yet serious health care problem, and we can take steps to address it and so build a stronger, healthier community; and
WHEREAS, to help achieve this goal, the U.S. Department of Health and Human Services, the Substance Abuse and Mental Health Services Administration, the White House Office of National Drug Control Policy, and Community and Family Resources invite all residents of Webster County to participate in National Alcohol and Drug Addiction Recovery Month;
NOW, THEREFORE, I, Greg Nolting Chairperson by virtue of the authority vested in me by the laws of Webster County do hereby proclaim the month of September 2006 as
National alcohol and Drug Addiction Recovery Month
in Webster County and call upon the people of Webster County to observe this month with appropriate programs, activities, and ceremonies supporting this year’s theme, “Join the Voices for Recovery: Build a Stronger, Healthier Community.”

WHEREAS: It is fitting and proper to accord official recognition to this magnificent document and its memorable anniversary; and to the patriotic celebration which will commemorate the occasion; and
WHEREAS: Public Law 915 guarantees the issuing of a proclamation each year by the President of the United States of America designating September 17 through 23 as Constitution Week,
NOW, THEREFORE I, Greg Nolting by virtue of the authority vested in me as Chairperson of Board of Supervisors in Webster County, Iowa do hereby proclaim the week of September 17 through 23 as CONSTITUTION WEEK

Gentlemen:
This letter is to summarize our understanding of the assistance and benefits sponsored by Webster County for Tate & Lyle’s construction of a 150,000 bushel per day corn wet mill for the production of industrial starches west of Fort Dodge, Iowa.
10-Year Tax Abatement - Webster County will, pursuant to Iowa Code Section 15.332, exempt from taxation all of the actual value added by the Project to real property that is directly related to the new jobs created by the Project for a period of 10 years, beginning with the year the improvements are first assessed for taxation.
New Public Road Access and Job Guarantee - Webster County agrees to construct a new public road access and turning lanes beginning approximately 0.4 mile west of Hayes Avenue and then south 0.5 mile to Tate & Lyle’s property in the South Half of Section 19, T-89N, R-29W, Douglas Township. The road construction will commence next spring. Estimated cost is $1 million and will be paid for with a $600,000 RISE grant and the remainder split equally between Tate & Lyle and Webster County, with Webster County’s share not to exceed $250,000. The $600,000 RISE grant is based on $6,000 per job for 100 jobs and Tate & Lyle will indemnify Webster County in the event the 100 jobs are not achieved or met.
Temporary and Permanent Closure of Hayes Avenue - Webster County agrees to temporarily close the portion of Hayes Avenue per your letter dated July 31, 2006, which allows you to initiate site construction that we understand will commence in October. Webster County will then proceed with permanent closure of said portion of Hayes Avenue in the next 60 days.
Directional Sign – Webster County agrees to allow Tate & Lyle to place a temporary 2-sided directional sign within the public right of way of Hayes Avenue south of Iowa Highway 7 to assist traffic to the site during construction.
This letter will serve as our understanding of the assistance and benefits between Webster County and Tate & Lyle, subject to the execution of a written agreement between both parties.
We are looking forward to the groundbreaking ceremonies on September 27th!

At 10:30a.m. a Public Hearing was held on proposals to classify a portion of public road in Section 10, T-86N, R-27W and a portion of public road in Sections 26 and 27, T-87N, R-27W as Area Service “C” (Hardin Township). No written or oral comments or objections being heard, Chairman Nolting closed the public hearing. Moved by Condon, seconded by Magnusson to approve:

WHEREAS, the Webster County Board of Supervisors, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service “C” roads pursuant to Iowa Code Section 309.57, and
WHEREAS, a public hearing was held at 10:30 A.M. on September 12, 2006 in the Board of Supervisors Room at the Webster County Courthouse in Fort Dodge, Iowa, on classifying the following described parcel of road right of way as Area Service “C”:
The portion of public right of way starting near the NW Corner of the SW1/4 of the SW1/4 of Section 10, Township 86 North, Range 27 West and running northeasterly to a point near the NE Corner of the SW1/4 of the NW1/4 of said Section 10, formally described as follows: That portion of the change in the Landreth & Skillet Creek Road (Book 3, PP 228) and the Landreth School House & Hardin's Ferry Road (Book 1, PP 77) commencing at the Cedar Center Road (As constructed) and thence running northeasterly to a point on the South Line of the North 1/2 of Government Lot 5, all in Section 10, Township 86 North, Range 27 West. According to the Secondary Road County Engineers Listing for Webster County, this segment of road is 0.528 miles and was reclassified as a "Class B" road by action of the Webster County Board of Supervisors on July 16, 1991 (Book 21, PP 151).
WHEREAS, proper and legal notice and publication were served and published according to the Code of Iowa, and
WHEREAS, the Iowa Department of Natural Resources submitted a letter dated April 16, 2004 requesting that said parcel of road right of way be closed due to a continuous problems with trash dumping, illegal off-roading, and other illegal actions, and
WHEREAS, there were no claims or objections received, either in writing or by persons present.
NOW, THEREFORE, BE IT RESOLVED, that the Webster County Board of Supervisors hereby classifies the following described parcel of road right of way as Area Service “C”:

I certify that Webster County has successfully completed the following FY 2006 NIMS compliance activities and is NIMS compliant.
1) Adopted NIMS at the community level for all government departments and agencies; and has promoted and encouraged NIMS adoption by associations, utilities, non-governmental organizations (NGOs), and private sector incident management and response organizations.
2) Incorporated ICS organizational structures, as defined in NIMS, into response plans and will manage all emergency incidents and preplanned events in accordance with ICS. ICS implementation will include the consistent application of Incident Action Planning and Common Communication Plans.
3) Coordinate and supported emergency incident and event management through development and use of integrated multi-agency coordination systems, i.e. Emergency Operations Centers (EOC’s).
4) Implemented processes, procedures, and / or plans to communicate timely, accurate information to the public during an incident through a Joint Information System and Joint Information Center.
5) Develop and implement a system to coordinate all federal preparedness funding to implement the NIMS across the community.
6) Revised and updated plans and SOPs to incorporate NIMS components, principles and policies, to include planning, training response, equipment, evaluation, and corrective actions.
7) Participant in and promoted intrastate and interagency mutual aid agreements with the private sector and non-governmental organizations.
8) Appropriate personnel as defined by the Board of Supervisors have completed IS-700: An introduction to NIMS.
9) Appropriate personnel as defined by the Board of Supervisors have completed IS-800 NRP: An introduction to National Response Plan (NRP).
10) Appropriate personnel as defined by the Board of Supervisors have completed ICS 100 and ICS 200 Training: Awareness and Basic Incident Command Training or equivalent.
11) Incorporated NIMS/ ICS into all local and regional training and exercises.
12) Participated in a NIMS all-hazard exercise program that involved responders from multiple jurisdictions.
13) Incorporated corrective actions into preparedness and response plans and procedures.
14) Inventoried community response assets to conform to homeland security resource typing standards.
15) Ensured that all relevant national standards and guidance to achieve equipment, communication, and data interoperability have been incorporated into acquisition programs, to the extent permissible by law.
16) Applied standardized and consistent terminology, including the establishment of plain English communications standards across public safety sector.

The Board of Supervisor met in Session on the above date with the following members present: Condon, Gill, Nolting and Lizer. Absent: Magnusson
Moved by Lizer, seconded by Gill to approve minutes of September 19, 2006 regular meeting and the Special Meeting of September 25, 2006 to canvass Merged Area V Community College Election held on September 12, 2006. Motion carried unanimously.
Moved by Gill, seconded by Condon to receive and place on file Manure Management Update for M & K Management, in Section 18, Burnside Township. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Lizer to approve and authorize Chair to sign amendment to copier lease agreements for MIS Department and County Attorney’s office. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Lizer, seconded by Gill to approve resolution to temporarily close McGuire Bend Road from the junction of Sara Avenue and 320th Street to the junction of Vasse Avenue and 320th Street due to road slide adjacent to Des Moines River. Motion carried unanimously.
Moved by Gill, seconded by Condon to approve and authorize Chair to sign utility permit application from Kevin Peterson to construct sub-drain between Sections 17 and 18, Clay Township approximately 100 feet south of the west quarter corner of said Section 17. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Condon, seconded by Lizer to adopt the following resolution:
RESOLUTION
WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255 and 321.285 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and
WHEREAS, such an engineering and traffic investigation has been completed by the Webster County Engineer.
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that the speed limit be established and appropriate signs be erected at the location described as follows:
- 40 MPH along Route P33 at Gowrie from 700 Feet south of 355th Street to 100 feet
North of 355th Street; and
- 25 MPH along Rout P33 at Gowrie from 100 feet North of 355th street to 100 feet
North of Route D60/Main Street; and
- 40 MPH along Route P33 at Gowrie from 100 feet north of Route D60/Main Street to
900 feet north of Route D60/Main Street
This speed limit shall be effective when the traffic control signs are erected.

Moved by Lizer, seconded by Condon to adopt the following resolution:
RESOLUTION
WHEREAS, there now exists a 28E Agreement known as the Mid Iowa Safety Alliance which is made up of numerous counties and cities within North Central Iowa, and
WHEREAS, the below named municipality desires to dissolve the 28E Agreement dated the 13th day of March, 2000 creating Mid Iowa safety Alliance.
WHEREAS, the original 28E Agreement dated the 13th day of March, 2000, provided for its amendment from time to time with approval of the majority of the body membership of the Mid Iowa Safety Alliance,
WHEREAS, the original 28E Agreement dated to 13th day of March, 2000, provided for dissolution of the 28E agreement upon a vote of 75% of the membership supporting such action,
NOW, THEREFORE, BE IT RESOLVED the Webster County Supervisors authorize the Chairman of the Board of Supervisors to sign the Resolution for this political subdivision to agree to the dissolution.

A General Relief Appeal Hearing was scheduled for 10:30a.m. However after a fifteen-minute wait, the appellant did not show and County Attorney advised the Board that the General Relief Director’s decision is upheld.
