Moved by Lizer, seconded by Condon to approve minutes of July 31, 2007, regular meeting. Motion carried unanimously.
Moved by Condon, seconded by Dencklau to receive and place on file resignation of Christina Ralston, effective August 3, 2007. Motion carried unanimously.
Moved by Dencklau, seconded by Motl to receive and place on file re-appointment of Bennett O’Connor to Civil Service Commission for three- year term, effective August 15, 2007. Motion carried unanimously.
Moved by Motl, seconded by Lizer to approve and authorize Chair to sign Class B Beer Permit Application for Des Moines Skydivers. Motion carried unanimously.
Moved by Lizer, seconded by Condon to approve and authorize Chair to sign utility permit application from Midland Power Company to bore and install underground electric line across 310th Street west of Sara Avenue between Section 18 and 19, Yell Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Condon, seconded by Dencklau to approve and authorize Chair to sign Janitorial Service Contract with ABM Janitorial Services, through August 31, 2007, for services at the newly acquired Bank of America Building. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Dencklau, seconded by Motl to table lease agreements with Elderbridge Agency on Aging, Bank of America and Farm Bureau, until August 14, 2007 regular meeting. Motion carried unanimously.
Moved by Motl, seconded by Lizer to receive and place on file Webster County Agricultural Extension Report of Operating Funds for fiscal year 2007. (Copy on file in Auditor’s office). Motion carried unanimously.
Webster County Extension Service discussed their plans to move their offices to the Crossroad Mall, which realistically wouldn’t occur until sometime around November 1, 2007. Mr. Patton stated that they are currently operating in their present location with no lease and have not paid rent for the month of August. Mr. Patton further requested that the Board consider no rent for this transition period to help defray the cost of relocating.
No action taken and both parties agreement to meet again in two weeks.

Moved by Dencklau, seconded by Motl to approve salary increases for the following Jailers: Doug Darrah to $12.26 per hour, effective July 19, 2007; Joshua Egesdal to $12.26 per hour effective, July 20, 2007; and James Skelly to $12.26 per hour effective August 13, 2007. Motion carried unanimously.

At 10:30 a.m. a Public Hearing was held on the proposed Area Service “C” classification for that remaining portion of public right of way described on Pages 129 through 132 of road Record Book No. 5, establishing a road 40 feet wide through parts of Section 3 and 10, Township 88 North, Range 28 West of the 5 P.M., known as the Holiday Creek and Coalville Common Consent Road. No written comments were received and oral comments were heard and noted. Chairman Nolting closed the public hearing.
Moved by Condon, seconded by Dencklau to adopt the following Resolution:
RESOLUTION CLASSIFYING A PORTION OF PUBLIC ROAD
IN SECTIONS 3 AND 10, T-88N, R-28W AS AREA SERVICE “C”
WHEREAS, the Webster County Board of Supervisors, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service “C” roads pursuant to Iowa Code Section 309.57, and
WHEREAS, a public hearing was held at 10:30 A.M. on August 14, 2007 in the Board of Supervisors Room at the Webster County Courthouse in Fort Dodge, Iowa on classifying the following described parcel of road right of way as Area Service “C”:
That remaining portion of public right of way described on Pages 129 through 132 of Road Record Book No. 5 establishing a road 40 feet wide through parts of Sections 3 and 10, Township 88 North, Range 28 West of the 5th P.M., known as the Holiday Creek and Coalville Common Consent Road.
WHEREAS, a resolution dated March 19, 1974 on Page 54 of Road Record Book 7 vacated the public right of way in the SE1/4 of the NW1/4 of Section 10, Township 88 North, Range 28 West of the 5th P.M., and
WHEREAS, the remaining portion of public right of way starting near the S1/4 Corner of Section 3, Township 88 North, Range 28 West of the 5th P.M. and running southwesterly to a point along the south line of the NE1/4 of the NW1/4 of Section 10, Township 88 North, Range 28 West of the 5th P.M. remains unimproved, and according to the Secondary Road County Engineers Listing, this remaining portion of public road is 0.410 miles and is the portion of Peterson Drive west of 230th Street.
WHEREAS, proper and legal notice and publication were served and published according to the Code of Iowa, and
WHEREAS, there were no claims received, either in writing or by persons present, and
WHEREAS, Phyllis Stewart and Paul Jordison commented they were opposed to maintaining the gate, and
WHEREAS, Paul Jordison commented he was concerned about the minimum level of maintenance of an Area Service “C” road, and
WHEREAS, Clifford Sturdevant commented he was concerned about the location of the gate and temporary vehicle parking projecting onto 228th and 230th Streets.
NOW THEREFORE BE IT RESOLVED, that the Webster County Board of Supervisors hereby classifies the following described parcel of road right of way as Area Service “C”:
That remaining portion of public right of way described on Pages 129 through 132 of Road Record Book No. 5 establishing a road 40 feet wide through parts of Sections 3 and 10, Township 88 North, Range 28 West of the 5th P.M., known as the Holiday Creek and Coalville Common Consent Road, being 0.410 miles and that portion of Peterson Drive west of 230th Street
BE IT FURTHER RESOLVED, that Webster County will be responsible to install and maintain the gate, and that the adjoining landowners will be only be responsible for promptly unlocking and locking the gate during each ingress and egress, and that the gate will be installed to allow enough space for a vehicle to be temporarily parked and not project onto 228th or 230th Streets, and that road maintenance will not be performed on a regular basis but will be adequate for access by adjoining landowners, except during, and a reasonable time period after, inclement weather.

David Seil, President of Webster County Farm Bureau discussed current lease agreement with Webster County. The Board will address their lease at the August 28, 2007 regular meeting.

Moved by Dencklau, seconded by Motl to approve and authorize chair to sign utility permit application from Prairie Energy Cooperative to replace overhead power poles and electric line along Taylor Avenue in Sections 8, 17, and 20, Webster Township. At l0:30a.m. a Public Hearing was held on proposal to classify a portion of public road in Section 27, Township 89 North, Range 29 West, known as the Breen and Laughlin Consent road, as Area Service “C.” No written objections were received and several landowners commented regarding the road being gated and access by unauthorized individuals. Chairman Nolting closed the public hearing.

WHEREAS, proper and legal notice and publication were served and published according to the Code of Iowa, and

WHEREAS, a portion of public right of way starting near the Center of Section 27, Township 89 North, Range 29 West of the 5th P.M., and running due south to the South One Quarter (S1/4) Corner of said Section 27 has been gated and locked for several years and remains unimproved, and
WHEREAS, according to the Secondary Road County Engineers Listing, this portion of public road is 0.441 miles, is classified as legal not open, and is the portion of Johnson Avenue south of Parker Drive, and
WHEREAS, adjoining landowners commented about the road being gated and locked for several years and expressed concern about access by unauthorized individuals,
NOW THEREFORE BE IT RESOLVED, that the Webster County Board of Supervisors hereby classifies the following described parcel of road right of way as Area Service “C”:
That portion of public right of way described on Pages 224 and 225 of Road Record Book No. 6 as the West Thirty-Three (33) feet on the West Side of the Southeast Quarter of Section Twenty-seven (27), Township Eighty-nine (89) North, Range Twenty-nine (29) West of the 5th P.M., known as the Breen & Laughlin Consent Road, being 0.441 miles and that portion of Johnson Avenue south of Parker Drive.

Sharon Gross, Clare City Clerk and other Clare City officials discussed drainage problems and storm damages. Board agreed to look into their concerns and hire a Drainage Engineer to investigate and address any issues.
