The Board of Supervisors met in Session on the above date with the following members present: Condon, Dencklau, Motl, Singer and Peterson. Absent: None.
Moved by Dencklau, seconded by Motl to approve minutes of the November 24, 2009 regular meeting. Motion carried unanimously.
Moved by Motl, seconded by Singer to receive and place on file the following Drainage Repairs: D.D.#29, D.D.#69, and Joint D.D.#70 Webster and #95 Calhoun. Motion carried unanimously.
Public Hearing was held on the first consideration to amend Zoning Ordinance 046 and further to amend the County Land Use Management Plan and Zoning Map to rezone property owned by Rick Harrington from A-1 to A-2; property described as commencing Sixty feet south of the northeast corner of the Northwest Quarter of Section Twenty-five (25), Township Eighty-eight (88) North, Range Twenty-eight (28) West of the 5th P.M., proceeding south six hundred-sixty feet (660’), then West parallel to the north line Four hundred Sixty-two feet (462’) to the point of beginning; Webster County, Iowa. No objections being heard, Chairman Condon closed the public hearing.

Moved by Dencklau, seconded by Motl to receive and place on file Webster County Mental Health, Mental Retardation and Developmental Disabilities Management Plan; and further to set 10:15 a.m. on December 15, 2009, as the time and date for public hearing on said plan. Motion carried unanimously.
Moved by Motl, seconded by Singer to receive and place on file proposed amendment to Webster County 043, an ordinance describing the forms of General Assistance provided by Webster County in accordance with Chapter 252, Code of Iowa to poor and needy persons; and further to set 10:30 a.m. December 15, 2009 as time and date for public hearing on the first consideration of said amendment. Motion carried unanimously.
Moved by Singer, seconded by Peterson to rescind the one percent salary increases, which were effective January 1, 2010 that were approved January 20, 2009 for elected officials and June 23, 2009 for department heads and staff. Motion carried unanimously.
Moved by Peterson, seconded by Dencklau to approve implementation of a hiring freeze. Motion carried unanimously.
Moved by Dencklau, seconded by Motl to direct each department under the General Basic fund to reduce Fiscal Year 2009-2010 Department Appropriations by ten percent and submit their reductions to the board by 9:00a.m. December 3, 2009. Motion carried unanimously.
Moved by Motl, seconded by Singer to approval of Option 2 of the Webster County LEC/Jail Report to New Construction Cost Comparisons as presented at November 24, 2009 meeting, which would be to repair the Law Enforcement Center, expect for the Jail Floor and construct a new jail facility contingent on voter approval. With an estimated cost of $11,420,000, less I-Jobs grant funds for a net cost of $9,510,000; of which the board would commit $2,700,000 from Lost Option Sales Tax Revenue to the project and would proceed to call for a special election to issue General Obligation Bonds for $4,900,000. Motion carried unanimously.
At 10:45a.m. a Public Hearing was held on Reclassification of Drainage District No. 5, Laterals 2, 4 and 5; and at 11:30a.m. a Telephone Meeting with Calhoun County for Joint Drainage District No. 15 Webster & No. 31 Calhoun and Joint Drainage District No. 22 Webster & No. 12 Calhoun was held. Moved by Singer, seconded by Peterson to approve salary increase for Cathy Casey to $19.84 per hour, effective November 27, 2009, and Sue Laufersweiler to $21.37 per hour effective October 18, 2009, per CPC Case Management salary. Motion carried unanimously.
Moved by Peterson, seconded by Dencklau to approve salary increase for Christy Nelson to $16.89 per hour, effective November 1, 2009. Motion carried unanimously.

Moved by Motl, seconded by Singer to adopt the following resolution:
RESOLUTION
RAISING FEES FOR ACQUIRE AND CONCEALED WEAPONS PERMITS
WHEREAS, it would be in the best interest for the Webster County Sheriff’s Office to charge an additional fee for Acquire permits and Renewals for Concealed Weapons permits to $10.00 and New Concealed Weapons permits to $15.00 to be effective January 1, 2010.
NOW, THEREFORE BE IT AND IT IS HEREBY RESOLVED, by the Webster County Board of Supervisors that this date met in lawful session that the Webster County Sheriff’s Office is hereby authorized to raise fees to $!0.00 for Acquire permits and Renewals for Concealed Weapons permits and $15.00 for New Concealed Weapons permits to be effective January 1, 2010.

RESOLUTION TO INITIATE VACATION OF ROAD
RESOLUTION, to initiate vacation of part of Webster County road known as “Langham and Watson Common Consent Road”, now known as George Avenue, running North and South and west of the center line of Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Fulton Civil Township, Webster County, Iowa.
WHEREAS the State of Iowa has acquired land for right of way for expansion of U.S. Highway No. 20, and
WHEREAS said U.S. Highway No. 20 right of way crosses George Avenue severing it into two separate parcels, and
WHEREAS no access to or across said U.S. Highway No. 20 by its limited access is being provided by the State of Iowa at George Avenue, and,
WHEREAS vacating said parcel would return same to the county tax roll, thereby benefiting the general public and returning said parcel to productive use,
NOW THEREFORE BE IT RESOLVED, the Webster County Board of Supervisors hereby proposes the vacation of the following described parcel of road easement, to wit:
All that part of the road originally known as the “Langham and Watson Common Consent Road”, now known as George Avenue, lying east of the East Right Of Way Line of the Union Pacific Railroad, between a line lying 100.0 feet north of the South Line of the Northwest Quarter of Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Webster County, Iowa and the South Right of Way Line of Webster County Road D-26 running along the North Line of the Northwest Quarter of said Section 12. Described parcel contains 2.85 acres, more or less.
BE IT FURTHER RESOLVED, that a public hearing by the Webster County Board of Supervisors on the proposed vacation of said parcel of road easement be set for 10:30 A.M. on Tuesday, January 19, 2010, in the Board Room of the Webster County Board of Supervisors, Webster County Courthouse, Fort Dodge, Iowa 50501, and the County Engineer send notice to adjacent Webster County landowners explaining proposed vacation and requesting their comments or claims.

RESOLUTION NO. 2009-12-22
A RESOLUTION AMMENDING THE WEBSTER COUNTY
FEDERAL FUNCTIONAL CLASSIFICATION SYSTEM
WHEREAS, functional classification is the process by which streets and highways are grouped into classes according to the character of service they are intended to provide; and
WHEREAS, Webster County periodically reviews the system of streets and highways for appropriate changes to classification of the various segments of the system; and
WHEREAS, a recent review of the system has revealed the need for a change to the Federal Functional Classification of road segments in the rural area of Webster County due to the change in traffic flow and functional use.
NOW, THEREFORE, BE IT RESOLVED that the Webster County Board of Supervisors hereby request changes to the Federal Functional Classification System be changed as follows:
- Change Fairbanks Avenue (Co Rd P29) from Iowa Highway 7 north to 140th Street (Co Rd C66) from Minor Collector to Major Collector. A distance of approximately 5.012 miles.
- Change Baxter Avenue and Dakota Avenue (Co Rd P29) from existing US Highway 20 north to Iowa Highway 7 from Minor Collector to Major Collector. A distance of approximately 7.814 miles.
- Change Quail Avenue / Dolliver Park Road / 260th Street / Oak Street / 255th Street from 290th Street (Co Rd C43) north and west to Nelson Avenue (Co Rd P59) from Major Collector to Minor Collector. A distance of approximately 4.871 miles.
- Change Fairbanks Avenue (Co Rd P33) from Iowa Highway 175 north to 340th Street from Minor Collector to Major Collector. A distance of approximately 2.024 miles.
- Change 340th Street from Fairbanks Avenue (Co Rd P33) east to Garfield Avenue from Major Collector to Minor Collector. A distance of approximately 0.993 miles.
- Change Garfield Avenue / Fourth Street (Gowrie) from 340th Street south to Iowa Highway 175 from Major Collector to Minor Collector. A distance of approximately 1.969 miles.

The Board discussed amending 28E Agreements with Callender, Clare, Duncombe, Farnhamville, Harcourt, Lehigh, Moorland and Vincent regarding maintenance of Farm to Market Extensions by changing the amount of road use tax reimbursement. Board deferred action until January 5, 2010.
