Moved by Dencklau, seconded by Motl to approve minutes of the June 30, 2009 regular meeting. Motion carried unanimously.
Moved by Motl, seconded by Singer to receive and place on file Sheriff’s Report of Fees Collected for period ending June 30, 2009. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve assignment of County held Tax Sale Certificate No. P080004 to Tom Filloon, Real Estate Parcel #01000-0719403007, taxes $50.00. Motion carried unanimously.
Moved by Peterson, seconded by Dencklau to approve Property Tax Suspension on Real Estate Parcel No. 00270-0904200004. Motion carried unanimously.

Moved by Singer, seconded by Peterson to adopt the following Resolution:
RESOLUTION
A RESOLUTION OF SUPPORT OF THE WEBSTER COUNTY TRAIL PLAN AND VISION IOWA APPLICATION
WHEREAS, the Webster County Board of Supervisors supports pedestrian trails and expanding the current trail system in Webster County; and
WHEREAS, the Webster County Board of Supervisors has chosen the trail extension from the Fort Dodge Nature Trail to Kennedy Park as the highest priority for trail development in Webster County; and
WHEREAS, the Conservation Board is working in partnership with the City of Fort Dodge and the Webster County Trail Task Force to expand the existing trail system for the social, economic, and health betterment of Webster County and the region;
NOW, THEREFORE, BE IT RESOLVED that the Webster County Board of Supervisors endorses this trail project and the Vision Iowa Application submitted by Fort Dodge and Webster County;

Following review of bids received, County Engineer Randy recommended that the low bid submitted by Midwest Contracting in the amount of $213,530.08 be approved.

Public Hearing was held on Final consideration to adopt proposed Webster County Ordinance No. 046: Zoning Ordinance establishing Zoning regulations for unincorporated portions of Webster County, Iowa. Several landowners in the area of the Webster County Ag-Industrial Center voiced concerns that some of the landowners were unaware of this classification change and further requested that the board recess this hearing for a week to allow.
Moved by Motl, seconded by Singer to recess hearing on final consideration to adopt proposed Webster County Ordinance No. 046: Zoning Ordinance establishing Zoning regulations for unincorporated portions of Webster County, Iowa, until 10:30a.m., July 21, 2009. Motion carried unanimously.
At 6:00p.m., an informal meeting was held to discuss the existing drainage problem in the area of Parker Drive. No action taken.

Resolution Naming Depositories
Resolved, that the Webster County Board of Supervisors of Fort Dodge, Iowa in Webster County, Iowa approves the following list of financial institutions to be depositories of Webster County funds in conformance with all applicable provisions of Iowa Code Chapter 12C.2 (1983) by 1984 Acts., S.F. 2220.
The Webster County Recorder is hereby authorized to deposit the Webster County funds in each of the respective financial institutions as set out below:

RESOLUTION CHANGING SPEED LIMIT ALONG ROUTE P-59
THROUGH COALVILLE AND KALO FROM 30 MPH TO 35 MPH
WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255 and 321.285 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and
WHEREAS, the Webster County Engineer received a written request dated June 1, 2009 from thirteen residents of Coalville to increase the speed limit; and
WHEREAS, such an engineering and traffic investigation has been completed by the Webster County Engineer’s Department.
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that the speed limit be changed from 30 MPH to 35 MPH and appropriate signs be erected at the location described as follows:
This speed limit shall be effective when the traffic control signs are erected.
- Along Route P-59 (a.k.a. Nelson Avenue) from the intersection of Route P-6D (a.k.a. 235th Street) south to intersection of Route D-33 (a.k.a. 255th Street)

AGREEMENT
This Agreement entered into this 21st day of July, 2009 by and between Webster County, Iowa, hereinafter referred to as the County, and hereinafter referred to as contractor.
WHEREAS, the County is desirous of obtaining animal control services on a contractual basis; and
The term of this contract shall be from the date hereof to and including the 1st day of August, 2009, and that upon mutual agreement of the parties, this contract and any amendment thereto may be renewed on annual basis thereafter. This contract will be for a one year period with a start date to be determined after proposal is awarded. This contract and any amendments may be renewed on an annual basis thereafter. Either party may terminate this Agreement upon 60 days written notice to the other parties for breach of the terms hereof. Moved by Motl, seconded by Peterson to table until July 28, 2009, the adopt Resolution approving the application of Brushy Creek Area Chapter American Red Cross for the purpose of receiving Community Betterment Grant Award from Prairie Meadows Racetrack and Casino, Inc. Motion carried unanimously.
Moved by Peterson, seconded by Dencklau to approve and authorize Chair to sign Iowa Department of Transportation Agreement #2009-C-285, which sets forth terms for Webster County to accept ownership and maintenance responsibilities for county road modifications on proposed improvements for Project NHSX-169-6(72)—3H-94 along U.S. Highway 169 in Webster County. (Copy on file in Engineer’s office). Motion carried unanimously.
At 10:30 a.m. a Public Hearing was held on the final consideration to adopt Webster County Ordinance No. 046: Zoning Ordinance establishing Zoning regulations for unincorporated portions of Webster County, Iowa. Margo Knippel stated she does not favor a second Agricultural Park in the area and it should be left in as Agricultural Conservation. Don Zahrobsky, Joe Gilbert and Mike Fitzgerald also voiced their opposition of an additional Agricultural Park in their area. John Kramer, representing Economic Development spoke in favor of the ag park area for economic future of Webster County and the regional area. Casey Johnson, representing Deerwood Subdivision Association voiced concerns of the lights, sound, smell and traffic with the current Agricultural Area.
Bill Thatcher, landowner in Section 30, Badger Township, an area currently zoned R-3, questioned the need for changing to a ten acre minimum from the current two acre minimum, stating that a two acre parcel for residential development is more salable than requiring ten acres. This requirement would limit the market that could afford to build in the rural area.
No further comments being heard, Supervisor Motl moved and Peterson seconded that this hearing recess until 10:30a.m. July 28, 2009. Motion carried unanimously.

RESOLUTION
A RESOLUTION OF WEBSTER County, IOWA APPROVING THE APPLICATION(S) FOR THE PURPOSE OF RECEIVING COMMUNITY BETTERMENT GRANT AWARDS FROM PRAIRIE MEADOWS RACETRACK AND CASINO, INC.:
WHERAS, Prairie Meadows Racetrack and Casino, Inc. has Community Betterment grant funds available that target Arts and Culture, Economic Development, Education and Human Services, and
WHEREAS, Prairie Meadows Racetrack and Casino, Inc. has a Community Betterment grant application cycle that ends August 15, 2009 and
WHEREAS, Webster County is supportive of these targets for improvements to the community and County, and
WHEREAS, one or more applications from Webster County and/or from organizations with projects that will take place on city property, will be submitted to Prairie Meadows Racetrack and Casino, Inc. by the August 15, 2009 deadline,
NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Webster County, Iowa that the county of Webster authorizes the following grant applications to be submitted to Prairie Meadows Racetrack and Casino, Inc. for the August 15, 2009 application cycle:
1. Webster County Conservation Board
2. Brushy Creek Area Chapter American Red Cross

At 10:30 a.m. Chairman Condon called to order the recessed Public Hearing on the final consideration to adopt Webster County Ordinance No. 046: Zoning Ordinance establishing Zoning regulations for unincorporated portions of Webster County, Iowa. Public comment was heard on excluding certain properties from the Ag-1 Industrial Ag district and removing reserve from the conditional uses in that area. Rhonda Chambers, representing the Fort Dodge Airport explained the need for the preservation of the air space in the County Zoning Ordinance. Roger Williams spoke in favor of his client’s property being included in the Ag Industrial district. Don Zahrobsky voiced his concern regarding water runoff from further development in the area.
Following public comment, Chairman Condon closed the public hearing.
Moved by Dencklau, seconded by Motl to amend section 4.05 changing the minimum lost size in the TA-1 (A-2) Transitional Agriculture district to two acres. Roll call vote: Ayes –Dencklau, Motl, Singer, Peterson and Condon. Nays none. Motion carried unanimously.
