The Board of Supervisors met in Session on the above date with the following members present: Condon, Dencklau, Motl, Singer and Peterson. Absent: None.
Moved by Dencklau, seconded by Motl to appoint Phil Condon as Temporary Chair. Motion carried unanimously.
Moved by Motl, seconded by Singer to appoint Keith Dencklau Chairperson for Year 2010. Motion carried unanimously.
Moved by Singer, seconded by Peterson to appoint Kim Motl Vice-Chairperson for Year 2010. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve minutes of the December 29, 2009 regular meeting. Motion carried unanimously.
Moved by Condon, seconded by Motl to authorize Auditor to issue warrants for Year 2010 when Board is not in session for the following named purposes: freight, express, postage, utilities, salaries and payroll where such compensation shall have been previously fixed by Board upon certificate of the officer or foreman under whom such compensation shall have been earned. Motion carried unanimously.

Moved by Peterson, seconded by Condon to appoint Cody Peterson, Weed Commissioner for year 2010. Motion carried unanimously.
Moved by Condon, seconded by Motl to approve the following appointments: Bob Singer, Cindy Litwiller and John Kramer to Midas Council of Government Board; Brad Luke to a five year term on Conservation Commission; Ray Ault to a three year term on Veteran Affairs Commission; James Kesterson and Kathy Hansel to five year term on Board of Adjustment; Margo Knippel and Greg Baedke to a five year term on the Planning and Zoning Board; and Dr. Daniel J. Cole as Medical Examiner for two year term. Motion carried unanimously.

Motion carried unanimously.
Moved by Singer, seconded by Peterson to table 28E Agreements with Badger, Dayton, Gowrie and Otho regarding maintenance of Farm to Market Extensions until January 26, 2010. Motion carried unanimously.
Public Hearing was held on final consideration of proposed amendment to Webster County Ordinance No. 43, an ordinance describing the forms of General Assistance provided by Webster County, in accordance with Chapter 252, Code of Iowa, to poor persons and needy persons. The amendment provides assistance to poor persons and eliminates assistance to needy persons. No written or oral objections being heard, Chairman Dencklau closed the public hearing.

Moved by Motl, seconded by Singer to approve minutes of the January 5, 2010 regular meeting. Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve salary increases per employment contract for the following Correctional Officers: John Reedy to $14.84 per hour effective January 18, 2010; Douglas Darrah to $14.03 per hour effective January 19, 2010; and Bryan Wilson to $13.12 per hour effective January 28, 2010. Motion carried unanimously.
Moved by Peterson, seconded by Condon to receive and place on file salary increase for LaVonne Pringle, Child Support Recovery to $1,665.18, every two weeks, effective February 7, 2010. Motion carried unanimously.
Moved by Condon, seconded by Motl to receive and place on file 6-month payroll adjustment effective January 1, 2010 for the Webster County Assessor’s office as follows: Jeanette Thanupakorn to$59,958; Angie Vinson to $47,966; Lori Owen to $39,065; and Jeanette Utley to $37,386. Moved by Peterson, seconded by Singer to approve appointment of Sheilah Schroder, as Part-time Planning and Zoning Administrator effective March 1, 2010 through June 30, 2010; and further to appoint Eddie Peterson and Robert Singer to propose the hours, wages and benefits of said position to be considered at next week’s board meeting. Moved by Motl, seconded by Singer to adopt the following resolution:
RESOLUTION
CONSTRUCTION EVALUATION RESOLUTION
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2010 and January 31, 2011 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WEBSTER COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

Moved by Singer, seconded by Peterson to approve salary step increase for Deputy Sheriff Geoff Miller to $45,553.36, effective December 17, 2009, per collective bargaining unit contract. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve employment agreements of Mike Richardson and Lynette Peterson as negotiated between Teamsters Local No. 238 and Webster County, per budget constraints; and to accept resignations of said employees. Motion carried unanimously.

A hearing on the proposed resolution to vacate the following described parcel of road right of way located in Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Fulton Civil Township, Webster County, Iowa, to wit:
All that part of the road originally known as the “Langham and Watson Common Consent Road”, now known as George Avenue, lying east of the East Right Of Way Line of the Union Pacific Railroad, between a line lying 100.0 feet north of the South Line of the Northwest Quarter of Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Webster County, Iowa and the South Right of Way Line of Webster County Road D-26 running along the North Line of the Northwest Quarter of said Section 12. Described parcel contains 2.85 acres, more or less.
WHEREAS, on December 15, 2009 a resolution to initiate vacation of the above described parcel was passed by the Webster County Board of Supervisors and in accordance with Chapter 306 of the 2009 Code of Iowa, a date was set for a hearing by the Board of Supervisors and legal action was served on all interested parties and said notice did state the hearing date was set for Tuesday, January 19, 2010 at 10:30 A.M. in the Supervisors Board Room, Webster County Courthouse, Fort Dodge, Iowa 50501 and
WHEREAS, said hearing was held on January 19, 2010 and all objections or comments, either oral or written were presented on or before said hearing date.
NOW THEREFORE, the Board of Supervisors of Webster County, Iowa having received all objections and comments hereby sets Tuesday, January 26, 2010 at its regular scheduled meeting time and place as the date for final action on the proposed vacation of the above described parcel of road right of way located in said Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Webster County, Iowa.

At 9:00a.m. the Board of Supervisors met to Canvass Drainage District #96 Director District #2 Election held on January 16, 2010. Moved by Motl, seconded by Singer to approve the following as the official canvass of said election: Ted Fiala - 6 votes; Scattering - 0 votes; Ted Fiala declared duly elected Drainage District #96 Trustee – Director District No. 2 for a three year term. Motion carried unanimously.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors of Webster County, Iowa, does hereby vacate the above described parcel of road right of way located in Section 12, Township 88 North, Range 30 West of the Fifth Principal Meridian, Webster County, Iowa, Fulton Civil Township.
BE IT FURTHER RESOLVED, by said Board of Supervisors, that the said vacated parcel of road right of way be reverted to the original landowners and/or heirs or successors, without further action by the Board.

Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Iowa DOT Federal Aid Funding Agreement Number 1-10-HRRS-002 for Bridge Replacement Project BROS-CO94(86)-8J-94 located between Sections 27 and 34, Badger Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Motl, seconded by Singer to open discussion on both Item #13 and #14 relevant to agreements with cities for construction and maintenance of Farm to Market Extensions and discussion followed.
Moved by Motl, seconded by Singer to approve amending 28E Agreements with Callender, Clare, Duncombe, Farnhamville, Harcourt, Lehigh, Moorland and Vincent regarding the construction and maintenance of Farm to Market Extensions by changing the amount of road use tax reimbursement from 100% to 50% in FY2011 and from 100% to 0% in FY2012. Roll call vote: Ayes – Singer. Nays: Condon, Peterson and Motl. Motion failed.
Moved by Motl, seconded by Singer to authorize County Engineer to negotiate 28E Agreements with Badger, Barnum, Callender, Clare, Dayton, Duncombe, Farnhamville, Fort Dodge, Gowrie, Harcourt, Lehigh, Moorland, Otho, Stratford, and Vincent regarding the construction and maintenance of all county road extensions within their corporate limits. Motion carried unanimously.
