The Board of Supervisors met in Session on the above date with the following members present: Condon, Dencklau, Singer and Peterson. Absent: Motl.
Moved by Singer, seconded by Peterson to approve minutes of the February 23, 2010 regular meeting. Motion carried unanimously.
Moved by Peterson, seconded by Condon to receive and place on file resignation of Megan Ruden, part-time employee at Public Health, effective February 23, 2010. Motion carried unanimously.
Moved by Condon, seconded by Singer to approve Class B Beer Permit Application for Lakeside Municipal Golf Course. Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve and authorize Chair to sign Flexible Benefits Plan for Year beginning January 1, 2010. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign three year contract with Westlaw for County Attorney’s office access. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Singer to approve request of the Walter Porsch Post 1856 of Veterans of Foreign Wars of the United States for the abatement of taxes on property purchase at 2851 5th Avenue South, Fort Dodge, Iowa, subject to County Attorney’s review. Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve and authorize Chair to sign Early Retirement Agreement as approved by the Conservation Board to reduce fiscal year 2011 budget. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to receive and place on file Manure Management Plan Updates for Price Finisher/Al Price in Section 7, Burnside Township. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Singer to approve authorization of the Y.W.C.A. to submit an Energy Efficiency and Conservation Block Grant Applications. Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve temporary closure of Fairbanks Avenue from 200th Street to Iowa Highway 7 between Sections 23 and 24, Township 89 North, Range 30 West, Johnson Township for replacement of a railroad bridge by Canadian National. Motion carried unanimously.

The Board of Supervisors met on the above date with the following members present: Condon, Dencklau, Singer and Peterson. Absent: Motl.
John Haila representing Haila Architecture discussed the Webster County LEC/Jail Related Projects options as follows:
LEC Repairs – All 4 Floors
Work on Lower 3 Floors ($3.82M) – Grant Funding $1,910,000 and County Contribution $1,910,000.
Jail Floor Repairs ($4.0M)
Jail Repairs $2,700,000 – Inmate Housing off site $1,300,000.
Total Cost: $7,820,000 Less Grant -$1,910,000 = $5,910,000 Amount Required to Bond
LEC Repairs – 3 Floors + 56 Bed Jail
Work on Lower 3 Floors ($3.82M) – Grant Funding and County Contribution
for Basement, First & Second Floors $l,910,000 each.
Build New Jail Off Site – 56 bed Jail – in lieu of 76 beds = $6,000,000
Total Cost: $9,820,000 Less Grant - $1,910,000 = $7,910,000 Amount required to Bond
Scott Stevensons with Ruan Securities discussed funding options. Understanding that the Board was not in favor of taking a general obligation bond issue to the voters for the renovation of the Law Enforcement Center and construction of a new jail facility paid for by property tax debt service levy, Scott discussed financing with General Obligation LOST Bonds paid for by Local Option Sales Tax revenue, noting that the interest payments would be substantially less with this option. It was noted that such funding option is subject to a reverse referendum, allowing for the voters to call for an election.
Chairman Dencklau declared a recess to allow for a scheduled press conference with Governor Culver highlighting the Culver/Judge I-JOBS initiative.
At 11:20a.m. Chairman Dencklau reconvened the meeting.
Moved by Peterson, seconded by Condon to call for a public hearing on a proposed issuance of General Obligation LOST Bonds not to exceed $9,000,000 for the renovation of the basement, first and second floors of the Law Enforcement Center and for the construction of a new jail off site. Motion carried unanimously.

Moved by Motl, seconded by Singer to approve minutes of the March 2, 2010 regular meeting and March 4, 2009 special meeting. Motion carried unanimously.
Moved by Singer, seconded by Peterson to receive and place on file Drainage Repairs for D.D.#5, Lateral 1. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve reducing the Webster County Compensation Board’s salary recommendations of the elected officials for fiscal year 2010-2011 one percent; resulting in no salary increase for fiscal year 2010-2011. Motion carried unanimously.
Public Hearing was held on the Adoption of Webster County’s Budget and Certification of Taxes, for Fiscal Year 2010-2011. No written or oral objections or comments being heard, Chairman Dencklau closed said public hearing. Moved by Condon, seconded by Motl to approve the Adoption of Webster County’s Budget and Certification of Taxes, for Fiscal Year 2010-2011. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Motl, seconded by Singer to approve salary increase for Shane Allen, Correctional Officer to $13.21 per hour effective March 9, 2010, per contract. Motion carried unanimously.
Moved by Singer, seconded by Peterson to receive and place on file resignation of Mike Passow, District 2 Road Foreman, from the Secondary Road Department effective March 31, 2010. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize County Engineer to fill vacancy in Secondary Road Department due to resignation of Mike Passow. Motion carried unanimously.
Moved by Condon, seconded by Motl to endorse and authorize County Engineer to sign regional surface transportation funding application for road rehabilitation project on Route P29 between U.S. Highway 20 and Iowa Highway 7 in Federal Fiscal Year 2013. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Motl, seconded by Singer to endorse and authorize County Engineer to sign regional surface transportation funding application for road rehabilitation project on Route D43 between Callender and U.S. Highway 169 in Federal Fiscal Year 2014. (Copy on file in Engineer’s office). Motion carried unanimously.
John Dencklau discussed Iowa Communities Assurance Pool refund in the amount of $12,467.30.
Jan Horton announced that starting April 1, 2010 the Motor Vehicle Department will open to the public at 10:00a.m.
Kim Motl stated that the Census forms will be mailed out next week and encourages everyone to fill out the form and return it as soon as possible. An accurate count for Webster County is important to ensure proper funding for the entire County.

Moved by Singer, seconded by Peterson to approve employment of Jordan Brackey, Assistant County Attorney, for a salary of $45,000.00 effective March 29, 2010. Motion carried unanimously.
Moved by Peterson, seconded by Condon to appoint Matt Wilson, Scene Investigator for the Webster County Medical Examiner. Motion carried unanimously.
Moved by Condon, seconded by Motl to approve bond of Al Price for Sewer/Septic Installation. Motion carried unanimously.
Moved by Motl, seconded by Singer to approve and authorize Chair to sign Amendment #2 to FY10 Local Public Health Services Contract. (Copy on file in Auditor’s office). Motion carried unanimously.

Moved by Condon, seconded by Motl to approve and authorize Chair to sign utility permit application from Webster-Calhoun Cooperative Telephone Association to bury fiber optic cable to upgrade their Duncombe and Vincent exchanges. (Copy on file in Engineer’s office). Motion carried unanimously.

NOTICE OF MEETING OF THE BOARD OF SUPERVISORS OF WEBSTER COUNTY, STATE OF IOWA, ON THE MATTER OF THE PROPOSED ISSUANCE OF NOT TO EXCEED $9,000,000 PRINCIPAL AMOUNT OF GENERAL OBLIGATION LOCAL OPTION SALES AND SERVICES TAX BONDS, AND HEARING ON ISSUANCE OF SAID BONDS
Public Notice is hereby given that the Board of Supervisors of the County of Webster, State of Iowa, will hold a public hearing on the 6th day of April, 2010 at 7:00 P.M., in the Board Room, County Courthouse, 701 Central Avenue, Fort Dodge, Iowa, at which meeting the Board proposes to take additional action for the issuance of not to exceed $9,000,000 General Obligation Local Option Sales and Services Tax Bonds of said County, bearing interest at the rate of note to exceed seven per centum (7%) per annum. Said bonds are proposed to be issued for the purpose of paying the cost to remodel, improve, extend and equip the existing County Law Enforcement Center, and to build and equip a new County Jail, and acquire land if necessary, as determined by the Webster County Board of Supervisors. Said bonds shall be payable from the eligible portion of the local option sales and services tax receipts collected by the County (equal to 100% thereof) and, to the extent provided in Iowa Code Section 423B.9(4), the debt service fund of the County.
At any time before the date fixed for taking action for the issuance of the bonds, a petition, signed by eligible electors residing within the County in a number of equal to at least three percent (3%) of the registered voters

Vic Carlson addressed his concerns on the drainage repairs that did not solve the problem in his area.
Jan Horton, County Treasurer announced that she will not seek re-election, retiring December 31, 2010.

Moved by Condon, seconded by Motl to receive and place on file 12 month salary increase for LaDon Sams, Mechanic to $19.05 per hour effective March 2, 2010 per labor agreement. Motion carried unanimously.
Moved by Motl, seconded by Singer to approve and authorize Chair to sign utility permit application from American Concrete Products to bury four inch water main along the east side of Quail Avenue from the corporate limits of Fort Dodge south approximately 1500 feet in Section 26, Township 89 North, Range 28 West, Cooper Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign permit application from Larry Carlson to install second 24-inch diameter culvert under Xavier Avenue approximately 1600 feet north of 140th Street in Section 23, Township 90 North, Range 27 West, Newark Township. Moved by Singer, seconded by Peterson to approve request from Peninsula Gaming LLC to temporary close and utilize portion of South River Road between 230th and 235th Streets and portion of 235th Street between Highway 169 and Madison Avenue from approximately 8:00 P.M., April 6, 2010 until approximately 2:00 P.M., April 7, 2010 for visit by Iowa Gaming Commission to view proposed casino site, subject to filing of acceptable Certificate of Insurance, for the purpose of a Peninsula gaming event. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve resolution to temporarily close Route P-29 to through traffic between Route D-26 and U.S. Highway 20 for construction of new U.S. Highway 20 and establish detour route. Motion carried unanimously.
Cliff Weldon, with Midas Council of Governments discussed a two and one half percent (2.5%) decrease in funding of the Iowa Medicaid Enterprises reimbursement, with addition reductions in July 2010. No action taken.
