The Board of Supervisors met in Session on the above date with the following members present: Condon, Motl, and Peterson. Absent: Dencklau and Singer.
Moved by Peterson, seconded by Condon to approve minutes of the April 27, 2010 regular meeting and special meeting of April 28, 2010. Motion carried unanimously.
Moved by Condon, seconded by Peterson to receive and place on file the following Drainage Repairs: D.D.#313 and D.D.#354. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Amendment Addendum to the Webster County Courthouse (Clerk’s) Unit collective bargaining agreement. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Peterson to approve and authorize Chair to sign Wellmark Blue Cross and Blue Shield of Iowa Health Plan renewal for fiscal year 2010-2011. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to appoint Andy McGill, Webster County Safety Coordinator effective May 4, 2010. Motion carried unanimously.
Moved by Condon, seconded by Peterson to receive and place on file Veteran Affairs Commissioner’s Report of Services for period ending March 31, 2010. (Copy on file in Auditor’s office). Motion carried unanimously.

Moved by Motl, seconded by Singer to approve minutes of the May 4, 2010 regular meeting. Motion carried unanimously.
Moved by Singer, seconded by Peterson to receive and place on file the following Drainage Repairs: D.D.#51 and D.D.# 197-Branch One. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve salary increase for Darren Herzog, Park Ranger to $36,921.00 effective May 14, 2010 per Conservation Department Salary Schedule. Motion carried unanimously.
Moved by Condon, seconded by Motl to accept resignation of Hillary Lenz, Clerk in Auditor’s office effective May 21, 2010. Motion carried unanimously.
Moved by Motl, seconded by Singer to table 28E Agreement between City of Fort Dodge and Webster County Treasurer requiring delinquent parking fines to be paid before renewing any motor vehicle registrations. Motion carried unanimously.
Moved by Singer, seconded by Peterson to approve and authorize Chair to sign utility permit application from Black Hills Energy to install 4-inch gas main along west side of Garfield Avenue and along south side of 340th Street in Section 1, Gowrie Township to their border station. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign utility permit application from Mediacom to install fiber optic line along west side of Route D20 at the intersection of Route D26 in Sections 6 and 7, Elkhorn Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Condon, seconded by Motl to adopt the following resolution:
RESOLUTION 2010-05-11
Temporary Road Closure of Webster County Route P59 to
Through Traffic between U.S. Highway 20 and
Webster County Route D20 and Designating a Detour Route
WHEREAS, Iowa Code Section 306.41 provides for the temporary closing of sections of roadway when necessary because of construction and maintenance, and
WHEREAS, the Webster County Engineer has been authorized by a previous resolution of the Webster County Board of Supervisors to execute the above requirements of Iowa Code Section 306.41 regarding temporary road closures, and
WHEREAS, Bridge Replacement Project BRS-CO94(85)—60-94 on Webster County Route P59 over the quarry haul road adjacent to Gypsum City OHV Park will require Route P59 to be temporarily closed to through traffic between U.S. Highway 20 and Webster County Route D20 during construction.
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that Webster County Route P59 be temporarily closed to through traffic between U.S. Highway 20 and Webster County Route D20 and a detour be established utilizing U.S. Highway 169/U.S. Highway 20 at Exit 121 and Iowa Highway 17/U.S. Highway 20 at Exist 136
BE IT FURTHER RESOLVED that the traffic control devices for the aforementioned road closure and detour route will be effective at 7:00 A.M., Monday, May 17, 2010 and shall continue for the duration of said road construction as determined by the Webster County Engineer.

Moved by Molt, seconded by Singer to approve Amendment #1 to the 2010 Fiscal Year Iowa DOT Secondary Road Budget and Construction Program. (Copy on file in Engineer’s office). Motion carried unanimously.
At 10:10a.m. Singer moved and Peterson seconded a motion to go into closed session pursuant to Chapter 21.5 (j) to discuss real estate acquisition for proposed jail site. Roll call vote: Ayes – Dencklau, Motl, Singer, Peterson and Condon. Nays – none. Motion carried unanimously.
At 10:35a.m., the board returned to open session. Moved by Singer, seconded by Peterson to amend Item No. 10 to approve and authorize Chair to sign Land Purchase Offer as discussed in closed session pursuant to Chapter 21.5(j).
Motion carried unanimously.

Moved by Peterson, seconded by Condon to amend prior Resolution for repairing main tile of Drainage District No. 189, by approving payment of a fifty foot (50’) permanent easement in the amount of $6,030.00 and reseeding the current CRP ground as damaged in the construction project. Moved by Peterson, seconded by Condon to approve Temporary (Seasonal) employment for Webster County Conservation – Kennedy Park as follows: Luke Winge, and Bradley Janssen, Temporary Full Time Park Ranger Interns at the rate of $9.00 per hour, effective May 17, 2010; and Debra Marnach, Temporary Part-time Cleaning Position at the rate of $10.00 per hour effective May 24, 2010. Motion carried unanimously.

Moved by Condon, seconded by Motl to adopt the following resolution:
ESTABLISHING TEMPORARY 35 MPH SPEED LIMIT
AND TEMPORARY 10-TON EMBARGO ON
4 MILES OF GRANULAR SURFACED ROADS BETWEEN
U.S. HIGHWAY 20 AND ROUTE D20 EAST OF ROUTE P59
WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255, 321.285, and 321.471 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and may impose restrictions as to weight of vehicles, and
WHEREAS, Webster County Bridge Replacement Project BRS-CO94(85)—60-94 requires Route P59 to be temporarily closed to through traffic between U.S Highway 20 and Route D20 and a detour route established; and
WHEREAS, motorists failing to follow the designated detour route have increased traffic on adjacent granular surfaced roads, and
WHEREAS, an engineering and traffic investigation has been completed by the Webster County Engineer’s Department, and
WHEREAS, due to current traffic flow, terrain, vegetation and development, traffic safety would be better served if a 35 miles per hour speed limit was temporarily established from Poplar Avenue at the intersection of U.S. Highway 20 northerly approximately 4 miles to Racine Avenue at the intersection of Route D20
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that a 35 miles per hour speed limit be established from Poplar Avenue at the intersection of U.S. Highway 20 northerly approximately 4 miles to Racine Avenue at the intersection of Route D20 for the duration of the bridge replacement project.
BE IT FURTHER RESOLVED by the Webster County Board of Supervisors that a 10-ton gross weight limit embargo be temporarily established to limit damage on above-described roads for the duration of bridge replacement project.

Joe Jackson inquired about an obstruction at the railroad bridge in Section 25, Fulton Township, Drainage District No. 5. Supervisor Peterson stated he is looking into this matter.
