The Board of Supervisors met in Session on the above date with the following members present: Dencklau, Singer, Peterson, Condon and Fletcher. Absent: None.
Moved by Peterson, seconded by Condon to approve minutes of the March 27, 2012 regular meeting. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to receive and place on file the following Drainage Repairs: D.D.#37; D.D.#48; Joint D.D.#90 Webster and #49 Wright; and D.D.#247 Webster and #7 Humboldt. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to receive and place on file Manure Management Update Plan for Dallas Thomas Home facility in Section 14, Cedar Township, Calhoun County. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve and authorize Chair to sign Certificate of Substantial Completion for 2011 Jail Repairs contract with Kolacia Construction. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to extend Request For Proposals to Provide Legal Services to Webster County for FEMA Flood Buy Out Program until April 20, 2012, since only on proposal was received and the grant contract requires that the amount bid by the attorney who responded must be validated as reasonable. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign utility permit application from MidAmerican Energy to set new electric transmission pole along 30850 Paragon Avenue at Southeast Webster School in Burnside. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to approve and authorize Chair to sign utility permit application from MidAmerican Energy to install new three phase electric line to new grain bin site at 2872 210th Street in Section 31, Colfax Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to receive and place on file 6-month wage adjustment for Jacob Stewart, Class C Equipment Operator, to $18.49 per hour effective March 26, 2012. Motion carried unanimously.
Several citizens voiced their concerns regarding the noise from ATV’s in the southeast part of the City of Fort Dodge.

Moved by Fletcher, seconded by Dencklau to receive and place on file the following Drainage Repairs: D.D.#2 and D.D.#57. Motion carried unanimously.
Moved by Dencklau, seconded by Condon to approve employment of Joshua Egesdal, Part-time Correctional Officer at the rate of $13.60 per hour effective April 4, 2012. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to receive and place on file resignation of Mark Thorn, permanent part-time employee of the Health Department effective April 6, 2012. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to approve Temporary Part-time employment of Verlyn Gregerson and Verlyn Gregerson, Jr. as Trail Technicians (OHV Park) at the rate of $11.00 per hour, effective April 9, 2012; and approve Permanent Part-time employment of James Stanberg, Natural Resource/Trail Technician II at the rate of $12.00 per hour, effective April 10, 2012. Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to approve and authorize Chair to sign Cooperative Reimbursement Agreement between Webster County (Host) Political Subdivision and the Department of Human Services, Bureau of Collections. (Copy on file in Auditor’s office). Motion carried unanimously.
Public Hearing was held on Fiscal Year 2013 Budget and Five Year Construction Program for the Webster County Secondary Road Department. Engineer Randy Will discussed the plan. No comments or objections being heard, Vice Chairman Peterson closed the hearing.
Moved by Dencklau, seconded by Condon to approve and authorize Chair to sign Fiscal Year 2013 Budget and Five Year Construction Program for the Webster County Secondary Road Department. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign contract documents with Fort Dodge Asphalt Company for hot mix asphalt resurfacing Project STP-S-CO94(93)—5E-94 on Route P29 from Route D36 north to Iowa Highway 7. (Copy on file in Engineer’s office). Motion carried unanimously.

Moved by Condon, seconded by Fletcher to approve salary adjustment for Malinda Jacobs, Clerk to $12.91 per hour, effective April 24, 2012. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to accept resignation of Jennifer Bonzer, Assistant County Attorney, effective April 27, 2012. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve request from County Attorney to hire full-time Assistant County Attorney immediately and a part-time Collections Clerk to begin approximately July 1, 2012. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve Class B Beer Permit Application for Mineral City Speedway, pending dram shop endorsement. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign proposal to re-skin existing doors on south passenger elevator in Law Enforcement Center; total cost for labor and materials is $980.00. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to approve and authorize Chair to sign utility permit application from MidAmerican Energy to relocate electric transmission pole to accommodate run off ramp at intersection of Easter Avenue and 210th Street in Section 34, Johnson Township. Berneice Buchanan, representing Community and Family Resources discussed Sunday Sales Grant. Board directed Berneice to discuss her request with Irene Blair.

Moved by Condon, seconded by Fletcher to adopt the following resolution:
WHEREAS, the Webster County Board of Supervisors on the 2nd day of November,2010 did enter into a contract with Jensen Builders, Inc. for the 2010 Law Enforcement Center Remodel Project, and on the 28th day of February, 2011 did enter into a contract with Jensen Builders, Inc. for the Webster County Law Enforcement Center Mechanical Upgrades project, and
WHEREAS, the Webster County Board of Supervisors has received a letter dated April 17, 2012, from Haila Architecture stating that the 2010 law Enforcement Center Remodel and the Webster County Law Enforcement Center Mechanical Upgrades Project are now fully completed, and
WHEREAS, it is the recommendation of the Architect that the Board of Supervisors accepts the 2010 Law Enforcement Center Remodel and the Law Enforcement Mechanical Upgrades Project as being fully complete and establish the date of acceptance of its completion, and
WHEREAS, upon acceptance of the above named projects ninety-five percent (95%) of the contract amounts can be paid to the contractor, while five percent (5%) will be required to be retained until the expiration of thirty-one (31) days after this date of acceptance, and
WHEREAS, in the event any subcontractor and/or supplier involved with said projects has reason to file a claim, the retained can be used to pay for the contested amount.
THEREFORE BE IT HEREBY RESOLVED that the Webster County Board of Supervisors hereby accepts the 2010 Law Enforcement Center Remodel and the Law Enforcement Mechanical Upgrades Projects as being fully complete and establishes the date of acceptance of its completions of this the 24th day of April, 2012.

At the April 3, 2012 Board meeting it was noted that only one Request For Proposals to Provide Legal Services to Webster County for FEMA Flood Buy Out Program was received; therefore the item was tabled and Requests For Proposals were once again sent to all Webster County Attorneys. No further proposals being received, Chairman Singer opened the following proposal from Eric Eide, P.L.C.

Following review of the one bid received in the amount of $4,500.00 submitted by Chris Dencklau for demolition/cleanup at 2457 Riverside Trail, per Dilapidated Building Ordinance, it was moved by Peterson, seconded by Condon to accept the proposal. Supervisor Dencklau stated he would abstain from voting on this matter. Motion carried.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign utility permit application from Frontier Communications to bury fiber optic cable along west side of Kansas Avenue in Section 22, Township 88 North, Range 29 West, Elkhorn Township.
