The Board of Supervisors met in Session on the above date with the following members present: Peterson, Condon and Fletcher. Absent: Singer and Dencklau.
Moved by Condon, seconded by Fletcher to approve minutes of the February 28, 2012 regular meeting. Motion carried unanimously.
Moved by Fletcher, seconded by Condon to approve salary increase to $19.57 per hour for Tami Swanson, Case Manger, effective February 22, 2012. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to receive and place on file Manure Management Plan Update for Price Finisher in Section 7, Burnside Township. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Condon to approve Class B Beer Permit Applications with Outdoor Service and Sunday Sales for Lakeside Municipal Golf Course and City of Fort Dodge-Rogers Sports Complex. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign Contract with Mid Iowa Development Association (MIDAS) Council of Governments to administrate a FEMA “Buyout” Program. (Copy on file in Auditor’s office). Motion carried unanimously.
The following proposals for final construction cleanup of the Law Enforcement Center were received: Service Master - $12,898.00 and Cleaning Connections - $4,805.00. Moved by Fletcher, seconded by Condon to accept proposal submitted by Cleaning Connections in the amount of $4,805.00 for the final construction cleanup of the Law Enforcement Center. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve application and permit from Hy-Vee Food Store for conducting portion of first annual Hy-Vee Half Marathon on March 31, 2012 within Webster County secondary road right of way. (Copy on file in Engineer’s office). Motion carried unanimously.
A public Hearing was held on final consideration of an amendment to Zoning Ordinance 046 and Future Land Use Map in the Comprehensive Plan to rezone property from A-1 to AG-I; said property described as follows: All of Section 24, Township 89 North, Range 30 West of the 5th P.M.; and the Northwest Quarter and the Northeast Quarter of Section 19, Township 89 North, Range 29 West of the 5th P.M., all in Webster County, State of Iowa. No written or oral comments or objections were heard; therefore Vice Chairman Peterson closed the public hearing.

Moved by Peterson, seconded by Condon to approve minutes of the March 6, 2012 regular meeting. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve salary increase for Shane Allen, Correctional Officer to $14.45 per hour, effective March 9, 2012, per labor agreement. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to approve resignation of Melissa Peterson effective March 9, 2012 and approve the employment of Jayci Zakeer, Part-time Correctional Officer at the rate of $13.60 per hour effective March 16, 2012. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve salary increase for Sheriff Deputy Josh Van Waes to $47,859.50, effective March 1, 2012, per labor agreement. Motion carried unanimously.
Moved Peterson, seconded by Condon to approve and authorize Chair to sign lease agreement for copier in Auditor’s office. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize the chair to sign the following: Memorandum of Understanding between the City of Fort Dodge and Webster County for Trail Construction Funding for the Soldier Creek Nature Trail - Phase II (Harlan Rogers Sports Complex to Kennedy Park).
WHEREAS, the County plans to enter into a contract with Howrey Construction, Inc. of Rockwell City, Iowa on March 13, 2012, for construction services related to the proposed Webster County Conservation Recreational Trail project, more specifically known as the Soldier Creek Nature Trail – Phase 2 (from Harlan Rogers Sports Complex to Kennedy Park), and
WHEREAS, the County underwent a bid letting through the Iowa Department of Transportation and Howrey Construction was the low bidder, and
WHEREAS, the City agrees to Pay Howrey Construction for the entire cost of said construction services as a part of the Vision Iowa Trails Project.
NOW THEREFORE, the parties agree and stipulate as follows:
The City agrees to:
1. Pay Howrey Construction for all costs associated with the scope of services shown in the Soldier Creek Nature Trail Phase 2 project plans. The bid from Howrey Construction total
$668,361.45. Payment to Howrey Construction shall be made on a monthly basis, within 30 days of invoice from the Contractor for work completed to date.
The County agrees to:
1. Administer the contract in partnership with the City.
It is further agreed that all parties shall approve any changes to the above terms.
This agreement shall be binding upon the heirs, successors in interest and assigns to all signatories to this agreement.
All parties of this agreement hereby and herewith agree to hold harmless and indemnify each of the other parties, their employees or representatives, from any and all liability to which they may be subject, arising out of the execution of this agreement.
This agreement includes paying any and all of the City’s expenses, costs and attorneys fees that may be incurred and/or related to the defense of any claim made as a result of the use of this facility.
This is the complete and final agreement of the parties and no statement not herein contained has been relied upon by any party in affixing their signature hereto.
All parties warrant that they have full and sufficient authority to execute this agreement and each party will sign whatever document is necessary to effectuate this agreement.

Moved by Fletcher, seconded by Dencklau to accept the bid from Howrey Construction for the Soldier Creek Nature Trail Extension - Phase II (Harlan Rogers Sports Complex to Kennedy Park) Project STP-E-Co-94 (92)—8V-94 in the amount of $668,361.45 and authorize Chair to sign Contract, contingent on the approval of said by the City of Fort Dodge, Iowa. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve applications and permits from Jerico Services, Inc. and Edwards Contracting to apply dust control treatment in 2012. (Copies on file in Engineer’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve application and permit from Mediacom to bury fiber optic cable from east corporate limits of Fort Dodge to cell tower at 2206 Racine Avenue. (Copy on file in Engineer’s office). Motion carried unanimously.

Moved by Fletcher, seconded by Dencklau to approve salary increase for Jordan Brackey to $56,778.00, effective March 29, 2012, per recommendation of Ricki Osborn, County Attorney. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve proposal from Jensen Builders for window installation in Room 212 Webster County Law Enforcement Center in the amount of $2,950.00. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Change Order No. 18 of 2010 Law Enforcement Center, Phase One Project increasing the contract with Jensen Builders in the amount of $4,443.00. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign Change Order No. 8 of the 2010 Jail Repairs Project decreasing the contract with Kolacia Construction the net amount of $7,051.44. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to review the following vendor proposals to purchase two tandem axle dump trucks with snow equipment: O’Halloran International, Inc $341,898.00, Interstate Motor Trucks, Inc $343,930.00 and Hawkeye Truck & Trailer $345,000.00.
Moved by Dencklau, seconded by Peterson to approve County Engineer’s recommendation to purchase two tandem axle dump trucks with snow equipment from O’Halloran International, Inc. in the amount of $341,898.00. Motion carried unanimously.
Moved by Peterson, seconded by Condon to review the following vendor proposals to purchase wheel loader: Murphy Tractor & Equipment Company $221,164.00 and Ziegler CAT $231,751.00.
Moved by Fletcher, seconded by Peterson to approve County Engineer’s recommendation to purchase the John Deere 644K Wheel Loader from Murphy Tractor & Equipment in the amount of $221,164.00. Motion carried unanimously.
A Public Input Meeting was held on the Draft MIDAS 2032 Long Range Transportation Plan. Shirley Helgevold with MIDAS Council of Governments reviewed the plan. County Engineer Randy Will commented on the exchange of STP federal funds for primary highway system funds as set out on page 3 and 4 of the draft plan stating that he believes this objective has merit and should be carefully pursued. No further comments, Chairman Singer closed the public meeting.

Moved by Fletcher, seconded by Peterson to approve application and permit from Deano’s Road Dust Control and from Heffron Services, Inc. to apply dust control treatment in 2012. Motion carried unanimously.
Specifications and proposals for the purchase two pickups were delivered to the following three in-town dealers: Fort Dodge Ford, Kemna Auto and Shimkat Motor. Webster County reserved the right to purchase two new pickups outright, or trade-in, sell outright or otherwise release two used 2004 Ford Pickups #120 and #220. The only bid received was from Fort Dodge Ford as follows:
Outright purchase $32,999.00 per each x 2 = $65,998 for Ford F350 2012 one ton extended cab 4-wheel drive with 36,000 mile limited full coverage; 60-month, 60,000 mile power train.
Trade –in Allowances $2500.00: #120, 2004 Ford Super Cab 4x4, Diesel, 8800 GVWR; excluding overhead reach with strobe, toolbox, fuel tank/pump, tailgate lift, road watch system, rear bumper and tailgate.
$2000.00: #220, 2004 Ford Super Cab 4x4, Diesel, 8800 GVWR, excluding overhead rack with strobe, toolbox, fuel tank/pump, tailgate lift, road watch system, rear bumper and tailgate.
Moved by Peterson, seconded by Condon to approve County Engineer’s recommendation to purchase two pickups outright from Fort Dodge Ford in the amount of $65,998 and solicit bids from the general public for the two used 2004 Ford Pickups #120 and #220. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve and authorize Chair to sign Purchase and Sale Agreement with Majestic Farms for the purpose of a new road at the Ag Park described as a parcel of land 120 feet wide by approximately 3000 feet long along the east side of Section 24, Township 89 North, Range 29West in Webster County, Iowa. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Peterson to table approval of contract for demolition/cleanup at 2457 Riverside Trail for four weeks, due to notification of a pending sale of the property. Motion carried unanimously.
The Board discussed the need of having a County Human Resource position. No action taken.
