Moved by Dencklau, seconded by Condon to approve and authorize Chair to sign Inter-Local Agreement between City of Fort Dodge and County of Webster, Iowa for 2012 Byrne Justice Assistance Grant (JAG) Program Award.
This agreement is made and entered into this 1st day of May 2012, by and between the COUNTY of WEBSTER acting by and through its governing body, the Board of Supervisors, hereinafter referred to as the COUNTY, and the CITY of FORT DODGE, acting by and through its governing body, the City Council, hereinafter referred to as the CITY, both of WEBSTER County, State of IOWA, witnesseth:
WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party: and
WHEREAS, each governing body finds that the performance of this agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement: and
WHEREAS, the CITY and the COUNTY agree to share the grant funds equally: and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the JAG funds.
NOW THEREFORE, the COUNTY and CITY agree as follows:
Section 1.
CITY and COUNTY agree to use all grant funds to purchase law enforcement equipment. The grant funds shall be shared equally with the Fort Dodge Police Department, the Webster County Sheriff’s Office. The Joint Drug Task Force operated by the Webster County Sheriff’s Office and the Fort Dodge Police Department shall receive 20% of the total award for equipment.
Section 2.
The CITY shall serve as the grant Fiscal Agent.
Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by Iowa Tort Claims Law.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which liability may be imposed by Iowa Tort Claims Law.
Section 5.
Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of services by the other party.
Section 6.
The parties to this Agreement do not intend for any third party to obtain aright by virtue of this Agreement.
Section 7.
By entering into this Agreement, the parties do not intend to create any obligations express or implied other that those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto.

ARTICLE I. IDENTIFICATION OF PARTIES AND PROJECT
This Contract is entered into by and between the Webster County Conservation Board (hereinafter referred to as the Contractor) and the City of Fort Dodge, Parks Recreation & Forestry Department (hereinafter referred to as the City) to share services in trail maintenance, natural resource management, park maintenance, and landscaping, in Webster County, Iowa (hereinafter referred to as the Project).
ARTICLE II. DESIGNATION OF OFFICIALS

ARTICLE III. TIME OF PERFORMANCE
Time of Performance – The Contractor shall commence work on the Contract on the beginning
date and complete Contract tasks by the ending date, as set forth on the title page of this Contract
under “Time of Performance,” unless changed by mutual written agreement. The contract may be
extended or amended by mutual written approval by both parties.
ARTICLE IV. STATEMENT OF PURPOSE
This Contract is entered into to provide natural resource management, park and trail maintenance activities in city and county parks, trails, wildlife areas, and right-of-ways.
ARTICLE V. SCOPE OF WORK
5.1 | Natural Resource Management – The Natural Resource/Trail Technician will assist with natural resource management on city and county properties (see Appendix A for a list of duties and responsibilities). This is a minimum definition that can/should be expanded upon by the Nat. Res./Trail Tech. as he/she works with key personnel for the Contractor and with key personnel for the City. |
5.2 | Maintenance – The Natural Resource/Trail Technician will assist with park and trail maintenance activities on city and county property (see Appendix A for a list of duties and responsibilities). |
5.3 | Coordination of duties – The Natural Resource/Trail Technician will provide key Personnel, on a weekly basis, via e-mail a schedule of weekly working hours and activity. He/she will also complete weekly time cards for hours of work completed. The Contractor will organize meetings, as needed, with key personnel from the City to discuss activities/actions that were completed in the previous month and direction provided to key personnel through a monthly report. On an annual basis, the Contractor will prepare for the City a written report of activities/actions from the season. The report will be presented to the City by the last working day in December. |
5.4 | Training/Continuing Education – the City and Contractor will be responsible for providing initial orientation and safety training. The Contractor staff may attend Training opportunities with the Iowa Association of County Conservation Board Employees, Iowa Parks & Recreation Association, and the Iowa Department of Natural Resources. The Contractor will notify key personnel of additional continuing Education opportunities and receive prior permission to attend and receive funding Reimbursement for said opportunities. |
5.5 | Equipment – The Contractor will supply transportation and necessary equipment and supplies when the Natural Resource/Trail Technician is working on county property. The City will provide transportation and equipment and supplies when the Natural Resource/Trail Technician is working on city property. |
5.6 | Employment/Liability – The Contractor will employ and compensate the Natural Resource/Trail Technician for the duration of the contract. Workman’s Compensation and general liability will be the responsibility of the Contractor and the City. The Contractor is responsible for Workman’s Compensation and general liability when the Natural Resource/Trail Technician is working on behalf of the County and the City will be responsible for Workman’s Compensation and general liability in the event of an accident when the Natural Resource/Trail Technician is working on behalf of the City. In the event of an accident, the other party will be notified immediately. |
ARTICLE VI. REPORTS
The Contractor shall submit to the City on an annual basis (December 31) a written progress
report. Progress report should cover what has been accomplished during the contract period.
These annual reports should also include copies of all reports and activities that have occurred
during the contract period.
ARTICLE VII. REVIEW OF WORK
The City’s key personnel shall have the right to review and observe at any time, anything defined
in Article V or in Appendix A.
ARTICLE VIII. FUNDING
The City agrees to fund the actual project costs in an amount not to exceed the Contract amount
as set forth on the title page of this Contract for the completion of the Service. (See Budget Summary
Appendix B.)
ARTICLE IX. PAYMENT
9.1 | The City agrees to compensate the Contractor for 50% of the Contract amount. |
9.2 | No Costs can be incurred before the beginning date or after the ending date as set forth in the Time of performance on the Title page unless a contract extension or amendment has been approved by both parties prior to the expiration of the contract. |
9.3 | The Contractor and City will not expend any funds not approved in this contract (See Budget Summary – Appendix B) without written approval from the other party prior to any expenditure for wages, equipment, or training. |
9.4 | The City agrees to pay 90% of the contract price within 60 days of receiving an invoice from the Contractor. The remaining 10% will be due upon successful completion of the contract. The Contractor will send an invoice for the balance of the contract amount at the end of the contract period with a final report. |

The purpose of this Agreement is to provide law enforcement assistance between each party, upon request, and jointly exercise law enforcement authority within each Party’s respective jurisdiction.
I. DEFINITION
A. Party means a political subdivision whose policy making body has adopted and executed this
agreement.
II. IOWA CODE CHAPTER 28E AGREEMENT
A. A peace officer employed by any of the parties to this Agreement shall have full power and
authority of a peace officer to act in any location within the jurisdictional boundaries of the
parties hereto when such officer is aware of criminal activity in said jurisdiction, observes a
crime occurring in his/her presence; or is acting pursuant to a request-for-assistance under
this Agreement.
B. A peace officer acting pursuant to the Agreement shall be deemed to be serving in the scope
of his/her employment.
C. Act subject to all the rules, regulations, and directives of the Peace Officers employer.
D. When assistance is provided under this agreement, command responsibility for the law
enforcement activity shall be determined as appropriate for the event.
E. In the event of budgetary of scheduling impact, the authority to determine the extent of
assistance shall lie exclusively with the commanding officer of the Responding Party.
F. Each party to the agreement shall be responsible for the compensation of its own employees
for payment of wages and overtime expenses, as well as payment of any disability, death,
worker’s compensation or other benefits which are owed or become owing or accrue to its
own employees as a result of activities undertaken pursuant to the terms of this Agreement.
G. Each party shall be responsible for the acts or omissions of its own employees to the extent
specified in Chapter 670 of the Code of Iowa which governs liability issues.
H. Each party shall be responsible for its own equipment and vehicles.
I. Following approval of this agreement by the parties, the Agreement shall be filed with the
Webster County Recorder and with the Secretary of State for the State of Iowa by the
Webster County Auditor.
J. This agreement shall remain in full force and effect until either Party terminates the
Agreement by providing notice to the other Party thirty (30) days prior to the termination
becoming effective.
K. The cooperative undertaking resulting from this Agreement will not create any new or

WHEREAS, Webster County, has made application through the Iowa Department of Transportation for funding from the Rail Road Revolving Loan and Grant Fund, in the amount of $100,000.00 for the total project cost, and
WHEREAS, Webster County recognizes the fact that this grant is based on a cost share basis with the state share not exceeding 80% and the local share being a minimum of 20% of the total project cost.
THEREFORE, Webster County agrees to provide and make available $20,000.00 (Twenty thousand dollars) of local monies to be used to meet the minimum 20% match requirement for this Rail Port Planning and Development Feasibility Study.

The Construction Permit Application of Michael Pearson - Mauer Farm for two new 2480 head, deep pit swine finishing barns for a new confinement facility in Section 3, Lost Grove Township was before the Board. Public Notice was published notifying the public that comments would be receive until 4:30 p.m. on Monday, May 21, 2012. No written comments were received and no comments were heard at this time. Supervisor Peterson acknowledged the matrix scoring met or exceeded the requirements and he agrees with the applicants scoring.
Moved by Condon, seconded by Peterson to authorize Chair to sign letter of recommendation to Iowa Department of Natural Resources for Construction Permit Application of Michael Pearson – Mauer Farm in Section 3, Lost Grove Township; recommending approval of said application. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to rescind Iowa Department of Transportation Funding Agreement Number 2012-R-008 for RISE Project RC-CO94-(095)—9A-94 for road improvement to Harvest Avenue from Iowa Highway 7 south past CJ Bio America manufacturing facility to main entrance of Cargill’s ethanol plant in Section 19, Township 89 North, Range 29 West, Douglas Township, which was previously approved on November 22, 2011. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve and authorize Chair to sign Iowa Department of Transportation Funding Agreement Number 2012-R-021 for RISE Project RC-CO94(098)—9A-94 for construction of new road located approximately 0.6 mile west of Harvest Avenue and extending approximately 3000 feet south from Iowa Highway 7 along the East Line of Section 24, Township 89 North, Range 30, Johnson Township. Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign Kelly Avenue Haul Road Agreement with Nick Garst due to new location of mineral extraction in South Half of Section 14, Township 89 North, Range 29 West, Douglas Township. Motion carried unanimously.
Moved by Fletcher, seconded by Condon to approve and sign Employment Contract and Agreement with Webster County Engineer, Randall J. Will, for the same terms and conditions as the current contract and agreement except for three year period with salary amount increased by three percent for fiscal year 2013, two percent for fiscal year 2014 and two percent fiscal year 2015. Ayes: Peterson, Condon, Fletcher. Nays: Dencklau. Motion carried.

ESTABLISHING SPEED LIMITS ON ROUTE P73 (RACINE AVENUE)
NEAR NORTH CORPORATE LIMITS OF DAYTON
WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255 and 321.285 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and
WHEREAS, such an engineering and traffic investigation has been completed by the Webster County Engineer in cooperation with the City of Dayton.
NOW THEREFORE BE IT RESOLVED by the Webster County Board of Supervisors that speed limits be established and appropriate signs be erected at the following described locations:
25 MPH along Route P73 (Racine Avenue) from 360th Street (6th Avenue) at the corporate
Limits of Dayton and continuing north 100 feet
40 MPH along Route P73 (Racine Avenue) from 100 feet north of 360th Street (6th Avenue)
and continuing north 500 feet
55 MPH along Route P73 (Racine Avenue) from 600 feet north of 360th Street (6th Avenue)
and continuing north
These speed limits shall be effective when the traffic control signs are erected.

Moved by Condon, seconded by Fletcher to approve minutes of the May 22, 2012 regular meeting. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to receive and place on file the following Drainage Repairs: D.D.#29, D.D.#34, and D.D.#57. Motion carried unanimously.
Moved by Dencklau, seconded by Condon to approve pay increase for Paul Keller to $14.45 per hour effective May 28, 2012, per Jailer Labor Agreement. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to approve request to assign tax sale certificate to Tenia Louise Miller and cancel the accrued interest on unpaid taxes against parcel #0729184010. Motion carried unanimously.

The following bids: Vogel Traffic Svcs, Inc $106,257.07, Iowa Plains Signing, Inc $111,995.63 and KAM Line Highway Markings $112,471.56. Moved by Fletcher, seconded by Condon to approve and authorize Chair to sign contract with Vogel Traffic Services for painted pavement markings in the amount of $106,257.07. Motion carried unanimously.
