The Board of Supervisors met in Session on the above date with the following members present: Singer, Dencklau, Peterson, Condon and Fletcher. Absent: None.
Moved by Peterson, seconded by Condon to approve minutes of the September 25, 2012 regular meeting. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to receive and place on file the following Drainage Repairs: D.D.#4 Webster & #272 Hamilton; D.D.#5; and D.D.#135. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to set October 9, 2012 at 10:00a.m. as the date and time for public hearing to consider adoption of County Multi-Jurisdictional Hazard Mitigation Plan. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve and place on file Five-year Performance Bond Renewal for U.S. Cellular Tower Site Number 760588. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to receive and place on file Manure Management Plan Updates for M & K Management in Section 18, Burnside Township; Grettenberg Finisher in Section 9, Dayton Township; and JDG Pork Enterprises. RESOLUTION
ERECTING STOP SIGN FOR SOUTHBOUND TRAFFIC
ON INDIANA AVENUE APPROACHING 280TH STREET
WHEREAS, the Board of Supervisors is empowered under the authority of Sections 321.236 and 321.255 and 321.345 of the Code of Iowa to designate any highway under their jurisdiction as a through highway and to designate any intersection as a stop intersection and to erect the signs at one or more entrances to such intersection, and
WHEREAS, the “T” intersection at the junction of Indiana Avenue and 280th Street common to Sections 32 and 33, T88N, R29W, Elkhorn Township and Section 4 and 5, T87N, R29W, Clay Township is currently not controlled by any regulatory signs, and
WHEREAS, present traffic would be better served if the southbound approach on Indiana Avenue was made the STOP approach to the intersection, and the east and west approaches on 280th Street were designated as through approaches, due to terrain, vegetation and development, which limit sight distance.
NOW, THEREFORE, BE IT RESOLVED by the Webster County Board of Supervisors that STOP and STOP AHEAD signs be erected in the Southeast Corner of Section 32, T88N, R29W, Elkhorn Township for southbound traffic on Indiana Avenue approaching 280th Street and that a SIDE ROAD sign be erected in the Southwest Corner of Section 33, T88N, R29W, Elkhorn Township for westbound traffic on 280th Street approaching Indiana Avenue.
This resolution shall be in effect when the traffic control signs are erected.

RESOLUTION
REDUCING THE SPEED LIMIT ON PORTION OF 220TH STREET
AND ON PORTION OF RICH MILL ROAD FROM 45 MPH TO 35 MPH
WHEREAS, the Webster County Board of Supervisors is empowered under the authority of Sections 321.255 and 321.285 of the Code of Iowa, to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may determine and declare a reasonable and proper speed limit, and
WHEREAS, such an engineering and traffic investigation has been completed by the Webster County Engineer, and
WHEREAS, the current speed limits on a portion of 220th Street and on a portion of Rich Mill Road along and adjacent to the Sheker Addition is 45 MPH
NOW THEREFORE BE IT RESOLVED by the Webster County Board of Supervisors that speed limits be established and appropriate signs be erected as follows:
- Reduce the speed limit from 45 MPH to 35 MPH on the portion of 220th Street from Route D20 west to Rich Mill Road
- Reduce the speed limit from 45 MPH to 35 MPH on the portion of Rich Mill Road from 220th Street north to Westwood Drive
These speed limits shall be effective when the traffic control signs are erected.

A Public Hearing was held on first consideration of an amendment to Zoning Ordinance #046 and Zoning Map to rezone property from ME to Transitional Ag or A-2 in the east one half of the Southeast Quarter of Section 9, Township 89 North, Range 29 West of the 5th P.M., Webster County, Iowa. No written or oral objections or comments were heard; therefore Chairman Singer closed the public hearing.
Moved by Fletcher, seconded by Dencklau to approve first consideration to amend Zoning Ordinance #046 and Zoning Map to rezone property from ME to Transitional Ag or A-2 in the east one half of the Southeast Quarter of Section 9, Township 89 North, Range 29 West of the 5th P.M., Webster County, Iowa; and further to waive second consideration and set October 16, 2012, at 10:00a.m. as the date and time for public hearing on final consideration of said amendment. Moved by Fletcher, seconded by Dencklau to approve and authorize Chair to sign permit from Jay Collins to connect private five inch tile from Southwest Quarter of Section 9, Johnson Township to existing eight inch tile along north side of 180th Street approximately 100 feet west of South One Quarter Corner of said Section 9. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve and authorize Chair to sign permit from Mediacom to bury and/or bore fiber optic line along west side of Old Highway 169, south side of 230th Street and west side of South River Road in Sections 2 and 11, Elkhorn Township. (Copy on file in Engineer’s office). Motion carried unanimously.
Moved by Peterson, seconded by Condon to approve and authorize Chair to sign application/agreement for horizontal curve sign program, which is administered by Iowa Department of Transportation and provides for a $10,000 grant to purchase signs for horizontal curves. (Copy on file in Engineer’s office). Motion carried unanimously.
Following discussion from Kelly Halstad that this grant could be used for attorney fees and engineering cost it was moved by Fletcher, seconded by Peterson to authorize Chairman Singer to notify Iowa Department of Transportation to accept the IDOT Railroad Revolving Loan and Grant for Rail Port Planning and Development feasibility of future development for the Webster County Ag Park.

Moved by Condon, seconded by Fletcher to approve employment of Alison Hauser as Lead Case Manager effective November 1, 2012 at an annual salary of $46, 925, with a six month probationary period. Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to approve a 60 month step increase to $23.35 for Meghan Lamoureux effective September 17, 2012. Motion carried unanimously.
Moved by Dencklau, seconded by Peterson to approve 60 month step increase to $23.35 for Cathy Casey effective November 27, 2012. Motion carried unanimously.
Moved by Peterson, seconded by Condon to purchase a Maytag Dishwasher $389.00 and a Amana Range $429.00 from Ross' Appliance Center for the Friendship Center. Motion carried unanimously.
Moved by Condon, seconded by Fletcher to receive and place on file County Recorder’s Report of Fees Collected for period ending September 30, 2012. (Copy on file in Auditor’s office). Motion carried unanimously.
Moved by Fletcher, seconded by Dencklau to reconsider appeal for the property located at 2009 Nathan Boulevard for purposes of purchasing the properties through the Webster County Buyout. Motion carried unanimously. Following discussion, it was moved by Dencklau, seconded by Peterson to approve said appeal in the amount of $105,488.93. Motion carried unanimously.
Moved by Peterson, seconded by Condon to reconsider appeal for the property located at 2197 160th Street for purposes of purchasing the properties through the Webster County Buyout. Motion carried unanimously. Following discussion, it was moved by Dencklau, seconded by Peterson to approve said appeal in the amount of $44,000.00. Motion carried unanimously.
Moved by Peterson, seconded by Condon to reconsider appeal for the property located at 2221 160th Street for purposes of purchasing the properties through the Webster County Buyout. Motion carried unanimously. Following discussion, it was moved by Dencklau, seconded by Condon to approve said appeal in the amount of $182,000.00. Motion carried unanimously.
A public hearing was held on the first consideration on the adoption of Webster County Ordinance No. 049: Code of Ordinances, an Ordinance readopting the existing County Code and repealing certain portions therein. No written comments or objections were discussed. Discussion followed regarding changes in Ordinance 028 and 031 which the board felt that such changes should be brought before the board in separate hearings. No further discussion, Chairman Singer closed the public hearing.
Moved by Fletcher, seconded by Dencklau to approve first consideration on the adoption of Webster County Ordinance No. 049: Code of Ordinances, an Ordinance readopting the existing County Code and repealing certain portions therein; and further to waive the second consideration and set 10:00a.m. on November 13, 2012 as the time and date for public hearing on the final consideration of said ordinance. Roll call vote: Ayes – Singer, Peterson, Condon, Fletcher and Dencklau. Nays – None. Motion carried unanimously.

Approving the Preliminary Official Statement for $1,345,000 General Obligation Capital Loan Notes, Series 2012
WHEREAS, a preliminary form of Official Statement has been prepared for the purpose of the issuance of $1,345,000 General Obligation Capital Loan Notes, Series 2012; and
WHEREAS, it is appropriate that the form of the Preliminary Official Statement be approved and deemed final and, upon completion of the same, that the Preliminary Official Statement be used in connection with the issuance of the Notes;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WEBSTER COUNTY, IOWA:
Section l. The Prelimary Official Statement, in the form presented to this meeting, be and the same is hereby approved as to form and deemed final for purposes of Rule 15c2-12 of the Securities and Exchange Commission, subject to such revisions, correcti9on of modifications as the County Auditor, shall determine to be appropriate, and is authorized to be distributed thereafter in connection with the offering of the Notes for sale.
